Contractor Installed Black&White Roof!

We hired a lisc. bonded contractor to put a roof on our home.

The home is an 1800 square feet ranch home, plus has a two car garage. Is not steep.

His crew of 7 guys tore off two layers of roof, laid plywood, and laid new roof all in 11 hours. This seems like an awfully short time to do a good job. What do you think?

More important though, is the fac that our roof is not BLACK AND WHITE. The roofer put slate grey roofing on most of the house, which we picked from a catalog that he gave us. BUT he put this ugly white looking stuff on our patio, and the white stuff goes up along the roof a bit too. It makes our house look like a shack!

We contacted the contractor and asked why our roof is two colors. His response was that with the roofing material we picked that white was his onlin option.

We said, look you told us to pick a color. We picked slate grey. You NEVER told us that our roof would be slate grey and white! We told you at the start that the house was being reroofed so that we can sell it. And, we told you that we wanted the patio to look nice - not with any ugly rubber or unmatching roofing.

His answer was that the contract did not specify that our roof would be one color - so basically tough crap for us.

I think that he should either:
A) Make our roof all matching AND make sure that our 30 year warantee still stands per our contract.
OR
B) Refund our money so that we can get another contractor to do the job right.

My Dad told me to call the contractors board.

What is your opinion on this. Is it reasonable for us as homeowners to expect one color roof? Does this guy have a leg to stand one? Is it reasonable for him to give us two different colors for our roof?

So why don't you try to settle this by offering him $500.00 less than what you owe him and find someone to come out and spray on some other color i have heard there are a few rubberized products that can be applied to match color of existing roof. why must you waste money on a lawyer. If he is that unreasonable Call your Department of commerce licensing division file a complaint. call The better Business Bureau File a complaint.
I still do not believe the roof was installed improperly, so filing complaints on somebody's license for unpreresolved asthetic issues isn't the right thing to do. IMO.

I have placed liens and never sen the court room. Has he ever placed a lien? Perhaps when he said that "you have to go to court" what he meant was "he has to go to the court house and see the county clerk."
Maybe youre right, Grumpy. I had to lien two properties, and he went in to court for the judgement, and placed the lien shortly after a reasonable period of time was given for them to pay. I only paid him $250. 00 a piece, which was added to the collection price, and paid by the customer.

When they get the lien notice, they tend to pay up quickly.
Well yes you have to go to court to get the judgement, but not to file the original paper work. Unless of coarse the lien laws are different in your county, however I thought the lien laws were a state law and not a county law.

Yup. Usually they pay when they get the lien notice. Sometimes they don't. Then you have to ask yourself... Do you wait until they want to buy their next car or take a loan on their property to get paid, or do you want to sue them to foreclose the lien? Decisions decisions.
I havent had to go that far, so I am completely ignorant on anything past the courtroom section. How do you foreclose the lien? What does this mean?
That's basically sueing them. It is done in court. The judge decides if youa re within your legal rights to foreclose.

The best way I can describe foreclosing a mechanicals lien is like a bank would foreclose on you if you stopped paying your mortgage. It's not identicle but sorta similiar. I too have never had to foreclose but that's how an attorney explained it to me.

The most important part is what does your written contract say? It should state everything the contractor is going to do for the said amount of money. And where in the contract does it say the contractor will void his warranty if someone else touches his work.( I have heard this garbage before) If your contract says slate grey roof I would not pay until I got what the contract stated. A Slate Grey Roof! Bring him to court.
Gunn Conn, you think the clause on anybody else touching your roof voiding the warranty is garbage, but you would think diferently if you had to deal with the jackleg satellite installers or HVAC contractors, etc, who have no regard for those having to be responsible for water infiltration. Get some expeerience with these sort of things beore you pass judgement.

What Aaron said is exactly the reason this clause exists. I will NOT be responsible for damage caused by others. This includes anyone. My warranty covers repairs of my fault only. Why would I warrant someone elses mistake?

This is a very very common clause within the roofing industry.
Thank goodness the automotive industry doesn't have the same kind of warranty that roofers apparently have, otherwise when Midas put a new muffler on a car it would void the warranty on the transmission. How 'bout when I get new tires, does that void any warranty on the brakes? Maybe if Midas puts on the WRONG muffler then an ENGINE warranty might be in jeapordy, but otherwise the remaining warranty is intact.

No one is saying that if someone damages another's work that the original warranty should remain intact, what's being said is that it doesn't neccesarily stand that a warranty may be withdrawn for an entire system if only a part of the system is impacted by modifications or repairs. If the satellite guy installs a dish on the eave and then chimney flashing on the other side of the house starts to leak does the dish installation get you off the hook for the flashing? If you think it does (or even want it to) you should re-examine your position.

Frankly, I thought some of that work looked pretty unprofessional (flashing and caulking stand out in my mind's eye). But I readily admit I'm no expert. Any re-work that Gotjacked? might have done by another contractor should be warranted by that contractor and the balance of the roof's warranty should remain intact - IMHO.

I don't know who you think you are AaronB but I have over 30 years experience in construction and handling people and contractors. What I said was IF you do not state that in your contract it will not help you to threaten a homeowner with it! And it is garbage. So what you are saying with your smart attitude is if a satellite installer installs their product and causes a roof leak then your warranty for your work is null and void. Give me a break. You should get some experience in talking to others on the internet without an attitude like you have. People are here looking for help not a smart mouth. Also try getting spell check so you look like you at least graduated high school.
Funny thing about the internet.... you cannot see any emotion in what I said. I can, however, in your post. I did not have a smart ass attitude. I did not have any attitude. I do not sugar coat stuff, generally speaking. I am pretty to the point. Just stating the facts.

If some HVAC contractors goes up on one of my roofs, and cuts a huge hole through it, well, I dont warrant it after that UNLESS I am called to do the roof repair. Then it is in still in full force.

Youre a General Contractor, how long do you warrant your construction? What are the terms of your warranty? What are the exclusions?
