Looks like you are not more than 24 inches to grade. Code in Canada is more than 24 you need railings 36 inches. As mentioned just bring the grade up to meet code 24 inches.

It depends on the type of foam that was sprayed. Closed cell foam does not require a barrier open cell does. Closed cell is very hard ,open cell very soft.
