2018 IRC. I don't have a subscription to the IBC. As has been stated....commercial may be entirely different.

Here in the exception they use the word guard not handrail.

I think all you need to do is make it 36" and you are covered no matter what.

If the intent is to be used with a handrail, then your 34" to 38" restrictions make sense.

If the intent is to just put a cap on a pony wall, and it will not have a railing attached (built in or otherwise), then your minimum is 34" and can go up to the ceiling if you desire.

There is no law against simply calling the building code people locally and asking about it either...

I think the 4 plex kicks it out of the IRC R5 and into the IBC R2 Which becomes 42 as a guard

310.3 residential group r2 - more than 2 units.

A four plex or fewer units are considered residential in most places, but it also depends on the zoning and as long as they are 3 stories or less.

Add: 310.3 is referring to apartment houses, etc., not side-by-side attached townhomes.

We use the same IRC and IBC as everyone else, and up here beyond a duplex is IBC. For insurance, beyond 4 units you have to get a commercial underwriter.
