I think all you need to do is make it 36" and you are covered no matter what.

If the intent is to be used with a handrail, then your 34" to 38" restrictions make sense.

If the intent is to just put a cap on a pony wall, and it will not have a railing attached (built in or otherwise), then your minimum is 34" and can go up to the ceiling if you desire.

There is no law against simply calling the building code people locally and asking about it either... ;)
