Quick Symptom Observations-Drugs


Nothing serious, just weed. I've got a guy that has been with us for just about a year. In the last 2 weeks, twice I and others smelled "skunk" on him after walking outside and he looks like a zombie quickly afterwards...but then again this is one of those guys that could qualify for dumbest person on the planet anyway. We trust him with tools not exceeding a broom usually.

I haven't partaken in this in a really long time but thoroughly enjoyed it when I did smoke a bong or two in the '80's.

I confronted him today about the suspicious smell and behavior. He calmly blew it off.

Prior to sending him packing, do any of you know a quick test for sobriety I can give him?

I know the smell and the look, but cops seem to be able to do this easily without a drop or blood test.

Any help keeping this all legal like will be appreciated.

Sure. But I am a 2-3 man show. I want to catch him soon after the act. We work in high end homes and I don't want clients to smell or see him like this either.

Trying to find a probable cause test to send him home. He's denied it so far, but just today it occurred again.

Leave out a bag of funyons. If he takes them, theres your proof!

Any idea where he goes off to beforehand? Drive for lunch, port a john, etc...

I had some medicine put in my eyes to dilate my pupils once, that was miserable they were huge all day long and super sensitive. If I were to smoke some ganja and get pulled over Id just tell the cop I had an eye test done that day.

I'm not sure if pot makes you stupid, or if stupid people smoke pot. Or both.


Pot stays in your system for quite a while. I've heard 11 days, don't know if that's accurate or not, but I do know that you can pull him anytime during that day and send him in for a drug test, and if it's there, it'll show up.

Do you have a written policy forbidding drug use?


Can a person collect unemployment if they were fired for using drugs on the job?

My take? Do not accuse him of taking drugs as the reason to fire him, unless you have some proof. Just give him his check and tell him he's not a good fit for your company. Not worth the risk, especially if he's a turd in the lawn anyway.

It's closer to 90 days. Though depends on what you're testing. Hair follicle tests can pick it up longer than it shows in urine. It's the longest half-life of any illegal drug, which is funny since it's the "softest."

Anyway, to OP, if you're going to fire him, base it on the fact that he's an idiot, not that he smokes. If he is a good worker (which it sounds like he isn't...), I would tell him to keep such things off your site and leave it at that. Selective drug testing is a slippery slope, especially if it isn't in the contract.

I know some smart, hardworking guys that do use pot, however because they are smart, they don't use it at work, or allow its use to impact their performance.

I suspect that it's sort of a selection bias: people think idiots are the only ones smoking it, because only idiots are dumb enough to let it be known that they do!
