First of all, your profile trade indicates Carpentry, why are you contracting work involving taping and painting.

Third of all are you licensed? If you not, going to court would be a waste of time if the state requires anyone in the construction trade to have a contractor's license.

That said if you only spend $200, take your loss and run, because if the job is really bad and there is a contract, they can go after you for what it will cost to repair.
Lesson learned, don't strap yourself into anything you never did before or don't know how to do it... and if you sub the work-out, make sure they know what they doing because your name is on it and you have to answer for it.

I don’t think the job was too bad. I’m a registered contractor, with an LLC, work comp, liability insurance, etc. @ KAP it was both, in the past, I’ve came in, hung rock, mud and taped, and never see the job again. This was my first time subbing out the painting as well. I never personally touched a paint brush at that job. I got photos, there’s two spots that look pretty ****ty, about a 1x1 area for both spots.

@Greg, I mostly do remodeling. Specializing in trim work. Just decided to take the whole job on, and that’s why I subbed out the following coats of mud, sanding/painting so I didn’t have to waste my time.

Update: they’re willing to pay 300$ out of the 1000$ they owe me. Figured I’ll take it, then file a lien on the property.

They will probably ask you to sign a lien release in exchange for a check.

Just said they mailed me a check for 360.00. Once it clears into my account I’ll file a lien for the rest.

Read the back of the check, you endorseing it most likely releases them of other debits and you forfiet your lean rights.

Lein rights are not with the contractor they are with the HO. You can forfeit lein rights for the 360 and dispute the rest. There's usually a place on the conditional for a disputed amount.

It may end up being like the old saying, "Throwing good money after bad". I've had a couple of jobs, over the 35 years that I've been in business, that didn't work out like I wanted. Only you can decide how much time you are willing to devote to trying to collect.

Lien, small claims court AND most importantly...contact the building inspectors office and turn them in for working without a permit.

This is good advice. From my experience the judge usually sides with the contractor on these type of judgements. (meaning YOU)

I got paid in full after having a lawyer reach out. Someone who isn’t me, without my say, had 7 people leave 1 star reviews and brought them from a 3.7 star company to a 1.8 and same on Facebook, they made it so you can’t even leave a star rating now.

I don't like the whole hurting someone's review or turning them in the the city officials but at the same time, people like this GC are the ones that hurt our industry and we can all benefit by "weeding them out"

At the end of the day, most of us out here are just trying to make an honest living and the "treat others as you would want to be treated" is becoming lost in our industry. So the OP may have not done everything perfectly but someone that deliberately tries to take advantage to benefit themselves deserve to be taken out of the business.

I agree, I paid my guys even when I didn’t think I was getting paid.
