AFAIK, and I'm pretty sure some know better about this, you're either free to go when you choose, under arrest, or being detained due to an investigation. I think there's a Supreme Court ruling dealing with Mirandizing that basically says once you're cuffed, you're constructively under arrest, whether you're told you are or not.

I've seen people ordered out of their own building because a neighbor called the police....

It's like I have always said a cop ask you to do something (within reason) just do it.

The reason being the cops make the law until you are before a judge, whether they are interpreting the law correctly or not is their call until you get to court.

Glad it all worked out.

I use to. Until I was harassed for absolutely no reason for a long 30 minutes to a point where I yelled at him then he finally sent me on my way. My kids use to say "cops are stupid" and I would say "no they're on your side" until that day. Since they were with me they say "see I told you cops are stupid"
And there's no way I can argue with them anymore

The problem usually comes down to interpretation. It doesn't take a lot upstairs to be a cop, and frankly, too many become cops for the wrong reasons. You tube is filled with videos of police failing to act within the law. Yeah, there are great cops out there, but a lot of loose cannons as well.

That's about as degrating as having to take your $160 boots off going through the metal detector at the court house to pull a NOC and being treated like a criminal going to a hearing for something your guilty of. Nasty court house floor. I'd be able to make friendly with the Sherrifs if they didn't have a different one there every time. But hey I guess it's for the better good of others.

That reminds me, I was at a large company Christmas party speaking with a said employee (not mentioning where) who used to be a highway patrol who admitted to profiling trucks with ladder racks because they were easy quota for DUI's. Yeah innocent until proven guilty right...

The main issue I have with DOT is they have turned into another parasite agency feeding off of the productive in our country.....all in the name of safety......sure thing.

This subject gets me fired up because it is all bs. I think the testing for all within the organization should be so hard only the smartest get in. I'd rather pay big bucks to a few smart folks as opposed to small bucks to a bunch of idiots.

The Oklahoma Highway Patrol used to be pretty elite because they did require at least an associates degree as a minimum.....too many small towns can offer a commission to clowns that cannot even write a complete sentence, let alone articulate a reasonable stop or suspicion leading to a stop......and I know this for a fact. My wife has to compile arrest reports for pre-sentense investigations, and it is a wonder that some of these guys know which end of the pen to use....professional? Hardly.

BTW, my wife's agency requires a bachelors degree to even apply, and a graduate degree to move up in rank.

So there's a little hope. Unfortunately I've seen no improvement. The small town I moved from had about the lowest iq I've ever seen on a force. Small town I'm in now, they're pretty good. Level headed and really care about citizens. Makes me proud

Miranda rights apply to questioning and has nothing to do with arrests. Handcuffing is not an arrest, it's a detainment. If you were handcuffed and let go you were never arrested.

Only the smallest do get in. It's very competitive. In the OPs story they were no doubt following department procedure. They didn't know who you were and are used to being lied to.

I certainly understand that situation. And most. And their actions most of the time. And one bad story gets told ten times to a good stories one time. But I guarantee. Some forces are hurting. Like where I moved from when a cop shot a kid on accident while shooting a BULLSNAKE. Killed the kid. Then the stories kept Coming. I typed a five page letter to the chief about an incident I was involved in, and I hate writing letters

That's the smart approach. It may change policy if it's gone too far, the chief is usually politically appointed and beholding to the mayor's office.

People get jacked up by fighting the cops and it goes downhill from there and lose whatever upper hand they had.

They were absolutely following procedure. They were courteous and professional the entire time. I wasn't bashing the cops in the OP, just relating a funny (to me) story. I have respect for LE (one of my best friends as well as my sister are cops), and I feel that respect has always been returned to me when I've been questioned by them.

When I worked at Pizza Hut one of our new managers accidentally hit the hold-up button while he was prepping the dough early in the morning. We had buttons all over the store and one of them happened to be in the walk-in freezer. Apparently he hit it looking for the light switch, didn't know what it was or think anything about it. A few minutes later there was this loud banging on the front dining room glass doors.

He went to the door all excited like, "Hi Officer Friendly! So nice to see you drop in on a wonderful day!" No sooner than he got the door unlocked they yanked the door open, rushed in, slammed him against the wall, and cuffed him.

We all know that bad guys don't always look like the McDonald's Hamburglar so you can't trust anyone in a holdup type of situation but the manager was wearing his Pizza Hut uniform with a an apron covered in flour. I seriously doubt that someone takes a hostage so that he can mix dough.

I think some cops get so jaded they don't believe anything they hear and only half of what they see. I was changing a dentist name on a sign and removing the vinyl lettering. A cop shows up to investigate this middle of the day act of vandalism.

Unfortunately my lettered sign truck and the new lettering wasn't quite enough to convince him of my legitimate purpose so he stood by and watched me a while. A long while really. It was a weird experience, I don't know what more he would have needed to see.

A lot of fine lines are involved. My point was not whether or not someone was "arrested", but where the court has found that a person was constructively arrested, even though the police had not "arrested" them at the time. It's a line as to when the police must Mirandize you before further questioning. It's the difference between what police might call investigation vs interrogation, but the court may find that the investigation was really an interrogation.

That's part of the reason you'll see police making public statements saying so and so is a person of interest and not a suspect. Circumstances of the questioning makes a difference - that was clearly laid out in the original Miranda decision.

Miranda rights really only offer protection if you may be prosecuted for a crime.
