Assuming you don't have an arbitration clause in your contract, if you plan on actually taking her to court, I'd let her know the last thing she needs to worry about are some leftover materials but rather the added costs she's adding for the matter to be heard before a judge and/or added lien costs if she doesn't pay...

And just let her simmer on that for a few days while she waits on a certified letter from you with the final demand for payment with a date certain for filing the lien and/or court case.

File a lien even if you are going to court, it will help maintain your position if court gets delayed

She doesn't care, she thinks she's going to win. She is harraSsing me about a warranty
now. She said "oh you're taking me to court? Hahaha . Good I can't wait for the judge to read all these text messages! ". I was like yeah I'm sure. The judge is going to be like, did you have a contract, did you complete the job ok judgement for the plaintiff. ". I'm going to post a Dropbox file of this chicks house and shed. You are gonna die when you see what she's complaining about. This shed is a rotten hunk of ****. It's fit for mosquitos and flys and rats. Not people. Hang on let me get the pics together..

She can't wait? That's usually the tell-tale of someone bluffing... Not advocating that you take her to court, but that you let her know you're serious as a heartbeat about it... Early on in my career, I had a lady who was referred to me by a landscaping guy in the same shop building we were who knew our work... I'll spare you the details, but it ended up going to court... same attitude... we were literally in the courtroom, and she calls me out in the hallway... check was written, and that was that...

If you've got everything in order, with documentation to prove it, she knows she doesn't have a leg to stand on... sending her the certified letter with date certain, along with the increased costs listed, to avoid that route through payment, usually sobers up the BS'ers...

Just be sure to follow through and have a lawyer write the letter... you can get a free consultation and a letter written through pre-paid legal services for a small fee each month... Companies like this...

I hate it when customers are this way.

File a lein.
Bill her for the missing materials. Nails, shingles, drip edge...send her a bill.
Then start proceedings for court. With the added stipulation that you are also suing for your attorney fees. I would probably throw in a stipulation and dollar amount for slander.

Most likely she will pay before it gets that far.

I've been lucky. So far, I haven't had this situation. Heard of it plenty. Even had a potential customer tell me how he took a bunch of 2x4 "because they were his". Guess what, No bid for you.

Yeah kap, you're right on she said 3 different times, "don't forget to let me know when the court date is... LMBO".

Like duh you'll be subpoenaed!.

She started calling me dumb and a liar and then decided I was on drugs and she was really just trying to piss me off. I think she is thinking that I was trying to talk to her lazy ass man. Like no bitch if I was I would have given him my number when he asked for it lol. But please keep that scrub off the market.

I do know if this helps .I was working with a few other guys . It was a deck .Another guy order all 12' decking . it was not effecient so i reordered . client wouldn't allow lumber company/or us to remove the 12' 1st delivery claiming it was hers .I stayed away ,she was nuts and I just couldn't handle it .The guy who did deal with her was the type just didn't listen .It seemed she ranted and he [like in another world] ignored her and calmly kept explaining .I guess since he did not argue back she ran out of steam and left -never ever on sight while we built the deck . So maybe you need to not feed into her rap .Be centered ,state the facts .

First of all, you picked this customer so suck up your share of blame.

Second, often times it's better to just let these types talk on the interwebby. Hopefully she's using lots of all caps. It is your response to her that the future customers you want care about, not necessarily what she is or is not saying. You'd be amazed at how sophisticated your potential customers are. Let her talk; the customers you want will take your side. I've had it happen repeatedly. She's adding a gold-standard believability to your reviews.

No kidding! Rotten piece of crap. Like how is it possible to make that look worse. And she thinks she's going to charge people to have parties there OOOOOOKKKIE!!👍. I still haven't gotten her check .. if I don't get it by tomorrow I'm going to file on her in small claims.

She's a total piece of work trying to run me down on FB. Like dont tell them how 3 other roofers came out and no one would even write you an estimate. Much less get you another 10 grand on top of the 4 they gave you! I shouldve taken every damn cent and not tried to help her out with anything.

Yeah I plan on suing her for defamation of character too but what can I get out of it?

Correct me if I'm wrong, but she seems to be focusing on just the shed, correct? Said she was happy with the main house.

Looks like to me, after tear off on the shed, she saw light coming in between sheathing gaps before it was papered--in her mind thinking that was wrong. Didn't understand R & R of sheathing was not approved by adjuster, and that it would be okay once paper & shingles went on top.

Also didn't realize, on a mansard, it takes time for those edge shingles to lay down over the ledge, especially when the shed is shaded by trees.
As for the outlet, looks like there was no box to begin with. Takes a couple of minutes to install an old style box. Freebie as a sign of good will?

Is that the gist of it?

Oh yeah.. so she sends me this letter along with the check, explaining why she should only pay 1500, and tells me that she will send another check for 300 once she receives her warranty information and if I didn't agree to those terms, I could send the check back to her. Lol. Um yeah.. why she thinks she can dictate my billing terms and warranty policy is beyond me.

I can't decide if I should write her a letter back or just cash the check and file the lawsuit.

Would the courts want to see that I responded to her "attempt" to reconcile?

I give a warranty on the whole job, not each individual part of the job. And I don't give any warranty until the job is paid in full.

To hell with her. Oh she also said I need to return her materials that I stole from her house. Lol. Im going to ask her to list the materials I stole from her house. Assuming you already told her that was the case... the next paperwork she receives should be the lawsuit or a certified date certain letter for remaining payment or you're filing it if you didn't tell her. Acknowledge her partial payment with a bill for the remaining balance as well as warranty provided on all products that only is applicable and goes into effect when full payment is received... be sure to tell her that in addition to the suit, it's necessary (important word) for you to also file the lien to protect your rights. Be sure to tell her (puts it on third party - removes the passion and that it's not just you saying it) this is the process your state has to deal with non-payment from customers and disputes where the parties disagree. Be sure to note that there will be increased costs for filing the lien and court costs if she chooses not to pay her bill.

All business going forward... no more texts, phone calls... just the facts ma'am... don't give her any more ammunition to say she "misunderstood" what you meant with more letters and texts...

If she doesn't respond to date certain, time to follow-through or let it go... there's no sense in having any more communication with her other than for her to receive the lien/suit notifications and/or filing. Let's her know it's not going away and you keeping any response all business going forward will let her know that she can't twist communications to her advantage...

IMO, based on what you posted, going to be very hard for her to make the case in court when she's already said she was very happy with the main part of the job...

Once it's in motion, move on mentally to the next... the rest will either work to your advantage or not...
