I just called the 1-800 number on the application, they said to go ahead and apply for the firm certification even if you have not been to a class. She said they will issue the firm cert, but you cannot do any work until you have training.

it would be interesting how many different answers we get- heres the number 1-800-424-LEAD

So register for a program we technically have never been informed about. There still has been no legal notifaction to any entity holding a home improvement license that they need to change there business habits. I even called my own insurance company to feel them out. They knew of nothing and insisted that until I heard from the state themselves I should not follow information from the internet. So I argued all the infromation I heard about as I would become a criminal doing what we have always done. If this cause's my rates to grow I will strongly consider going out of business. Everyone has scared me into signing up for the class but I dont see it moveing forward or working. No one is going to pay your company to be slower at what you do and charge a heavy chunk more to do it. People will do the work themselves or the ones who can afford to do it will scale down projects and wait longer. After we all get pushed off the cliff, the government will tell us we shouldn't have jumped. I spoke with a plumbing inspector the other day and he said he had not one set of plans to review. Thats scary.....now is the best time of year planning a spring build.

This simple contract clause may help with keeping this ruling in line.
any pre-1978 property owners need to agree to and pay for an initial XRF test certification BEFORE any work starts or final pricing is committed to; and that if lead IS found then pricing will be adjusted accordingly to allow for the proper remediation as required by the regulations.

Amazingly not as many homes contain lead as people think. I took the class last week and it is amazingly simple. contain, clean and dispose properly.. Seems like a real money maker to me....

The problem with this is, If the homeowner does get a lead Inspector to do an XRF test and it proves positive for lead, the lead inspector by law has to notify the health dept. and that will open up a whole new set of problems for the homeowner. Lets just say,unless you are a certified lead abatement contractor, you at that point won"t be doing any work there.

Anyways you as a certified contractor can do a swab test to check for lead.

Unfortunately in Massachusetts certified renovation contractors are not allowed to do their own lead testing. Lucky us! We have to hire it out anyways or just presume lead exists.

Why do you say that? Just the presence of lead paint, especially in good condition, is not a problem, just something to be properly managed. This situation varies by state. In California, there is a form which goes to the state, but that does not mean that anything else will happen.

Well it is a problem if kids that live there, and they have elevated lead levels.
In CT the health department will insist on blood sampling for kids under six if the lead Inspector shows positive lead levels. And let the lead abatement begin. Have seen this many many times since 1993.

And again my question is why not just do a lead check swab test in the areas you will be working in, unless of course you happen to be a certified lead inspector or abatement contractor to.

I do stand corrected Mr Wright. Thank you. I remember now when I was filling out the form, that in the check list there was no check for including a copy of RRP Cert. I thought this was odd, that we need this Cert and it is not needed to show the EPA. I called the place where I took the class, and asked if I needed to send this information. They said yes, otherwise the EPA would not know that someone in the firm was Certified. !? A case of bad information from the informed. I appoligize for miss informing, to all.

our instructor told us it would be faster if we waited to get the Cert first and not just fill out the form with the number. that supplying them with a real copy of the cert would be better.

i'm not sure what i'm going to do at this point. i know i wont' have anything by the 22nd.

Good link Chris, thank you. Very educational as to how each lobbyist creates "a need" relative to their discipline. I got a few things from that.
A There will be a lot of money injected into construction. That's encouraging!
B We will need more certifications that don't include the lead certification to be able to prosper. More complication.
C There will be a variety of more complex red tape to be informed about. Auditors, regulators, expeditors, financial qualifications and inspectors will play a role in its success. Again very complex to navigate once your certified to do it.
D While they were working on a clean energy bill called "Home Star Program" they didn't realize that the other "RRP bill" is virtually unknown and would cripple the whole intention of the stimulus program unless delay for an unspecified duration.
E For the sake of creating jobs they left leave out DIY'ers but then several Senators wont support the bill for it. So nothing will really get accomplished.
F It will take a small team to operate any company to navigate codes, rebate stuff, legal stuff and product knowledge as well as your normal skill set.
G Nothing has changed as far as the RRP deadline, although its noted to be a major roadblock.
H People still need a job to give us the money so we can give it back to government and government can give the money it borrows from china right back to them.
I Investing is MASCO may be very lucrative.

2 questions:
1) if we are Certified already, do we need to follow the procedure(by law) if we start the install BEFORE april 22 ?

2) is it any work after april 22? what if the contract was signed before then?

#1 - technically NO

#2 - 4.22 is what counts - you may not start, continue working on, etc... unless you are certified & following said regs

Correct - the reg does not take effect until April 22nd. You still have to hand out the RR pamphlet - that has been on the book since Dec 08. (did you get your firm cert yet?)
