Would Any Of You Sign This Contract?

Better question, would any of you write it?

Entertainment time folks!

I want to know if any elses sides hurt.

This was presented to me by a GC on Saturday evening. Our proposal went out a month ago, office never responded to 2 follow ups. The super on the job kept calling saying his office was on it. I perused the guys website ( shiny and current ooh la la) and he styles himself as having done 200 commercial projects for all local clients in the past 10 years. My suspicions were already raised. I cut and paste parts of glowing news articles he had posted about the company in the Google machine and there simply was no matches. and 1 of the papers did not exist. zero yelp reviews except for 4 hiddens that stated he burns subs. Address on website doesn't match the home address of a 2 million home that he gives in his signature. All four people he gives extensions for do not answer the phones.

This one is a doozy. It will make yer eyes bleed

I will be RESPECTFULLY declining.

It was a good, succinct read, actually.

Long on fine print, exceedingly short on scope of work.

Re: Would Any Of You Sign This Contract?

At least you have to feed a slave in the winter time: It you sign that contract, you'll die poor owning the GC money.

Doesn't pass the Golden Rule, revers ability test, would the GC sign as YOUR sub?

10 % retention till the owners happy with EVERYTHING????

You got to make everything fit together, even if you didn't mess it up or build it? WTF????

Constantly broom cleaning???? Even masonry or civil engineering?

Run Away from this butt clown, alert the Authorities, Building inspectors, bank officers, state and local law enforcement bunko squads.

Re: Would Any Of You Sign This Contract?

I only read the first three pages, but it looks like a standard boiler plate commercial subcontract agreement.

Re: Would Any Of You Sign This Contract?

As a GC we always used a very lengthy subcontractor agreement to protect ourselves as much as possible. This is what smart contractors do.

Smart subs read and understand it all word for word before they sign and agree to anything. Most always just signed ours and went ahead, but a few of the more sophisticated ones would cross out and red line one or more things they disagreed with, then we would have to discuss to decide what both parties could live with or without.

Your suspicions about the GC possibly being shady are a whole different issue. If you have serous concerns regarding their treatment of subs or ability to pay you, it would probably be wise to talk to some subs who have worked for them, then decide if you should get involved.

That contract is picture book example of responsibility with out AUTHORITY, A LOT of Risk, Very Little reward.

Not All crooks are as Obvious.

Be polite, just say NO.

Check pockets and wallet when in some safe space......

Some GCs earn their share, a small % steal it....
