whats the liability on varnished wood steps
 
hypothetical here:blink:

metal framed stair case , going to entry to town home
steps are wood- 2x12`s.
2x12`s rotted .



they were replaced with yellow pine , and varnished with exterior varnish.


more than a year later:
ups delivery guy slips , and fall down stairs

lawyer of home owner calls, and wants to hold a carpenter liable

is that carpenter liable?

After a year, owner could have legal exposure. Did they maintain them? Did they know they were slippery? Did they do anything about it?

Didn’t we have a thread exactly like this about a year ago? I think it also included a UPS driver. Those guys are clumsy. And litigious.

This actually makes no sense. The insurance company handles insurance claims on the property, and it would be the ins company's lawyer defending against any claim.

More to the point, many jurisdictions require permitting and inspection of repairs or replacement if required egress elements. If permits were required and you didn't pull them, shame on you.

You can be liable if you have a money jar...aka liability ins.

Don't comment on the matter AT ALL !

You may get a demand letter or one saying your a defendant in a law suite....me, I'd wait for the Sheriff's papers to show up, then give to my ins. co.

Btw, any pics of the UPS guy in the gyro contraption at the hospital...?

ups guy has work comp insurance...

wc ins can come after ho...

if it goes to court the judge will likely say that as the construction professional it is up to you to advise on and provide proper products for a given situation....

i never got a response
but i really like going on here.
so i made a new email address , and got back on


these people have hired a lawyer , and he has sent me some certified letters saying i am to blame.

i responded that i didn't recall doing this work.
they have no record or purchase orders of me doing the work .
i did many different jobs for these .
i told him" i don`t recall doing this work , and to please send me any paperwork tying me to it"

I have a close family member who is a big shot judge. The best advise he has given is- Never speak to a lawyer who is not representing You! Lawyers speak in lawyer language and the rest of the country speaks English.

Yes!!! That is great advice because the other lawyer is not going to help you, they are there to help their client!!! They're going to help whoever writes their check!!!

i did find an attorney.

i will only speak to him
