Home inspectors can be sued but all the damages you will get are for his fee, most of the contracts specify this in the fine print.

Had one 2 years ago, guy got his $700 back after inspector failed to see corroded water lines because he was too lazy to crawl in crawl space which was 4 ft high

The ones I've seen specify areas not inspected. Plus anything not readily visible is excluded. I could see where not having a look in a crawlspace would be a problem, even with the exclusions.

Think about it. They don't have a shield from any code jurisdiction, and if they screw up a sale, they can be successfully sued.

I used to do alot of work for a very good real estate agent based on these Inspector Reports. In every one of their contracts, it states that they cannot be held liable. In additon, they all carried E & O coverage.
I thought of most of these reports as suggestions, more than anything else.

I view them as things to have checked by a competent professional. Same as with insurance inspectors.

If it's any consolation this inspector will be out of work soon if he's nitpicking these things to the point that he's jeopardizing sales. Simply, the real estate agents won't hire or recommend an inspector like this. They want someone who will find the major stuff or give just enough info to negotiate, and not so much that it scares away the buyer. If I was a clueless home buyer I'd run from this house after that report.

Madrina, what does your warranty say? If it's outside the warranty period or parameters (acts of God, weather, things out of your control, etc.) and there's a trip charge clause, there's no reason NOT to get paid...

Joasis was right on the money with code references... you can use that PA expertise to your benefit as well...

The contract they sign is with the client, or realtor.

Not with a seller. And as my attorney has made clear, immunity shields are small obstacles to break down.

On a spec home I built 10 years ago, an inspector had a list of deficiencies...BS items that were not in code...but where he screwed up was saying the roof structure was not framed properly. The client withdrew their offer, and the sale was cancelled.

Now, I was pissed....I filed a complaint...and nothing....so I turned the lawyer loose on him. And while he could not be held liable for his silly list of crap...calling them "items to be concerned with", he made that one statement that screwed his pooch. When you make a bold statement that something is not done right, and an inspector from the state verifies it is indeed correct, and all you can say is "I was wrong", and the sale is lost, someone is paying. I got paid. We sent him a notice of intent to sue and wanting his insurance information, and also a request for his resume in preparation for a deposition, he knew he had a problem.

He quit after that one. And I still sold the house. Never had any more issues with inspectors in this market.

Well the fact of getting paid is not at the top of my concern. The homeowners are more than willing to pay for me to do these things I just think it's BS that they have to even spend the money on stuff that doesn't need to be done. They want the house sold so they'll do whatever has to be done to make that happen. What I meant when I said some of it may not be billable was that if something should have been done originally that wasn't like valley metal I wouldn't charge them to do that. Even though I could and they would but I don't think that's right if that were the case.

Is metal valley required by code?
If not, don't do it.

Let the ho know it isn't required and if the buyers wants it, you will be glad to give them a price for a new roof once they have settlement.

Just to ad, whenever I had to do repairs based on the HI's report, no one EVER came back and reinspected the suggested repairs. I mean NEVER!

I think valley metal is required.. or mineral roll or ice and water. And it's there. I know it's there. But how could he tell from the ridge. The home owners aren't sweatin me at all. It's the buyers. The homeowners are like REALLY!?? They already hate the buyers... They just want it sold. They are my favorite customers ever. Nicest people on the planet.. I hate to see them go.
