Hmmm, so if it is you and a few buddies in the basement and he "trips" and falls from the stairs and maybe breaks his jaw or loses a few teeth, all your buddies will be witnesses that he "tripped".
I kinda like that plan.

Basically he has been paid for your work but not distributed your portion, it's a legal thing and he can be charged personally if he is the owner/president of the company

In these situations, progress payments to the builder should have been 2 party checks so he can't cash them.

bankruptcy is easy to do, however, fraud is not...and the trustees do look for it..however,get a good bankruptcy atty who is buddy buddy with the trustee,and all of a sudden, something just might get "overlooked"...

its up to you to find out as much as you can and show up at the meeting of creditors,which you should receive notification on..

you can dispute the bankruptcy, but must have substantial evidence and reasoning on why it should pass and why you should be paid.. I can tell you this..
he did not open a new construction/building biz right before filing..he would be a total dope to do that..personally and business wise..

laws just dont work like that...

His bankruptcy will be denied if you can show that he planned to screw everyone which sounds easy to do in this case. He committed fraud.

Find out the name of his new business and buy the domain name. Example xyzbuilders buy www.xyzbuilders.com and put the list up of who he owes. Invest in cheap lawn signs about a hundred of them put his buis or personal name is a thief and your new website. Drive around and put them all out one night. Could also put an ad in the news paper. Just some ideas don't get in trouble though. Also call his house and cell phones every night about 3 am or 4 am just to screw with them.

That is a great idea about the domain.

Seriously though, I have proof that he created an LLC 2 days after filing Chapter 7. I have proof that he owns nearly $2 million in real estate. I have proof that he was paid by the bank for our work. I am really counting on this bankruptcy to get dismissed. I'm crossing my fingers.

you still have yet to say if he filed chapter 7 for his business or for personal.

either way, forming a new biz it not a very wise idea..and you have this info, the trustee will too...its amazing the info they have access to.all they do is put his info into a program and everything he owns, co owns, accounts, investments, properties..everything comes up..

I hope you do prove things in your favor..but he can own as much as he wants peronsally and bankrupt every business that he opens if he wants..

He can own a holding or real estate investment firm and have nothing to do with his construction Co.

those links would have to be made and that take forensic accounting..

I would get all parties together so as to share the legal costs. Also I believe that if he was paid and did not dispurse this proves missmanaging of funds that are basically "in trust". If so, I think he can be sued personally.

Check with your attorney. But try to get the others on board 'cause it's gonna cost you.

This exact scenario has happened around here too, of course. Why there are not tougher laws against this.......there was a guy here that owed subs to the tune of like 500k.....he was taking vacations in the tropics, etc. Total scumbag loser.
