I agree, and we have loaned money to the company.

If I didnt have a partner I would probably do the same. As it is, we get a salary, truck, tires, fuel, phone and some perks and thats it until December. Keeps it simple that way.

Partners I can see where you are at in that. My dad had a partner for years. They were great together. They each knew their place. Neither had a big ego. That's usually the down fall of a partnership. It's also important to not hold chit in of you have a problem.

If he isn't paying you, he definitely isn't paying your payroll/ social security taxes, or workers comp. insurance. So don't get hurt!

I don't know about your state, but in California, if an employee doesn't get paid, they wages continue until they get caught up. That means if you don't get paid, and walk off, the boss owes you up to thirty days pay as a penalty.

Call your local labor board.

You know, his name ends in sub, but he says he's an employee and has discussed this as an employee... a little clarification from OP might help...

Re: Can I Get You Next Week?

I had hired a guy this fall that had been out of work for awhile. I overheard him talking to another guy in mid December that he was coming up short for his kids and wife for Christmas.

After work I put three hundred in his hand and said I wanted $30 per day back starting Feb 1st until it was paid back. He started paying me back in mid January and had it all paid off within two weeks.

Felt cool to help him out and not get run around when it was time to get paid back.

Like, actually taxes taken out and W-2 provided at end of the year? If so, as mentioned, if there are payroll problems, you might want to confirm the money being taken out of your check is being filed quarterly...
