Contracts


I am using AGC contracts for my work here in Florida, is anyone in commercial construction using their own drafted documents? and if so what guide lines did you follow to write them, AIA, AGC, both or other.

I only ask because as my company grows it would probably be more time and cost effective to have "in-house documents".

But is it worth the effort and expense to do this?

What does Expedition have to do with writing contracts? it's used to manage paperwork on a job, but not to generate the proper contract language for the contract to begin with.

In response to the original question, I'd start with finding out what the "norm" is in your area. Are most owners looking for a certain contract (or are architects recommending a certain contract)? As a contractor, the most favorable contract to you is the AGC forms (the precise version of which depends on what type/size of jobs you do), as the AIA forms lean more toward what's best for the architect.

Starting from scratch is a costly venture for anything but the smallest/simplest agreements, and "standard" contracts have proven the test of time in court far better than anything you and your lawyer can ever drum up.

Bob, I appreciate the response, as I said previously I use AGC documents now, (unless the client insist's on another). I have just found myself sometimes short of a particular document (my mistake) and was just kicking around the idea of creating my own, and wanted to see if anyone else had gone that route.
Personally I have enough to worry about without creating contract's that are as well defined as AGC, so I think I will just make sure to have enough on hand in the future.

Like I said just a thought.

You can also buy the Docubuilder software from AGC, which allows you to electronically fill out and print their contracts- then you don't have to worry about running short on paper contracts. I think there's a small setup cost and then they charge you for each contract you use.

Funny, I just wrote myself a reminder to get that set up tomorrow,after looking over the AGC site again,amazing when something is right there in front of your face, sometimes and you need a kick in the butt to see it!!!.
