Is Plumber Or Homeowner Responsible For Protected Street Paving

Is Plumber Or Homeowner Responsible For Protected Street Paving


When a plumber replaces a residential water service main and digs up a protected steet to get to the tap, (in NYC, a protected street is a street paved less than 5 years old), is the homeowner or plumber ultimately responsible for the proper repair and patching of the street?

i.e. if the plumber or his subcontractors doesn't repair the street to the satisfaction of the city, can the homeowner who contracted the job be held responsible to fix it?

Well, in my city if you pull a permit to dig into the street you must post a bond with the city for a 'reasonable' value as they see fit in case this happens...I'll let you decide what the next step is when the city isn't satisfied.

Just out of curiousity, did the city not send an inspector...namely an engineer...to watch this whole process take place? Someone (who the permit holder pays for) always witnesses the excavation, tap, replacement and compaction and final paving. Something is amiss here, it can't get this far before the city kyboshes the screw up and takes over.

Tom If I do a water main or anything to a street or city sidewalk we have to fix it that is written in the contract which you agian have to have the city sign off on before you start digging.
