What Would You Do In This Situation?


I am currently painting an exterior of an attached home

(Check my other thread "fed up with residential")



Attached home where the rear is stucco on both sides

Basically, the only separation is a thin line down the middle, other side has a different texture stucco. My client is telling me to go 2.5" over the separation because thats her property. 2 neighbors has been disputing over issues for years. Now the neighbor approaches me, pulls me aside and told me nicely that he has been having problems with her and she is very troublesome. He asked nicely for us not to interfere with his property and not to make no new separations. He said if we did, that we will have issues.... no brainer here , court, lawyers, .... the works..


Homeowner is requesting that i go the 2.5" over.



Im 90% sure if i do not make that new separation, that they will give me issues with my payment. Which again is a no brainer, court, lawyers. the works..


Ive been avoiding working that area... keeping busy with others... lol


Ive spoken with the daughter, (client speaks very little) ive told her the story and she said to leave it the way it is. I guess the mother wasnt satisfied with that decision and daughter tells me to leave until tomorrow until the father comes.

Do you live in New Mexico? Everything you do has super drama? I lived there for one yr. Got out fast. Try and feel out your customer before a job. Why don't you paint 1.25'' over and tell them both to **** off!

Charge her for the time you spend finding out exactly where the property line is. At least after you know this, you will be farther from lawyers.

See if the local building inspector can step in and mediate the difference of opinions between the two neighbors. He can have access to the plat of survey and tell the HO's where there property lines actually are.

AND, get a signed change order for the additional time for the inconvenience factor and the additional time dealing with this non-painting issue. She should hire a suveyer to pin-point the dividing line.

I ran into this before in painting condos. The big difference was that there were no neighbor disputes. Just a matter of where to stop. I would find out where the property line is, that way you will not risk being sued by the neighbors.
