Wc And Liability For Newb


hey all, i have been painting for years now and trying to get fully legit so i can work for anyone, i am working with a local occipational lic. (which i have to go renew asap) and a florida DBA since its not my full name, i need to get some tyte of insurance but since its just me im not sure what i need.
as i understand it liability will cover the jobsite no tools or persons right?
and work. comp covers me only right?
apparently im only required by law to have comp but can be required by the homeowner or hiring company (contractor) to have liability also
so in such case where and what do i look for, and how much is these things going to cost,
ive been told just to be comp exempt then its only 50 bux per year to be legal. no comp no lia. just occ. lic and DBA
i like being responsible for myself but i also like to work, and i need these things to make the next step in getting more business,

also does anyone know whats required by new home builders? as i would like to get into that market if possible,

you ain't gonna like the advice, but it's the best you are going to get:

speak with an attorney and/or an accountant in your area. familiar with your state and local laws and regulations.

anything else is just foolish to follow when i comes to this stuff.

Hey amc....Nice to another FL painter on here. We actually have quite a few now.

As far as all that stuff goes. If you want to be legit, get the liability. There's no reason not to show the customer you want to protect their interests.

As for w/c. That's up to you. If you already have a business name, occupational license, etc. it sounds like you're just missing out on insurance.

New home builders, I can't help much with. I don't think anything else is required.....you will have to have the liability for them though, and a good chunk of it at that.

Other than that, I would say contact your ins. agent and have them help you...

AMC: For new Const. you will also need W/C OR W/C Exempt. for our area you also need to be LLC OR INC. Hey AA Paint... down my way we no longer need the county occupational lic. only one for the city.

Hey amcline, in Florida you can file once with the state for 125.00 and get a name registered which will save the DBA and etc from sole prop from the license dudes, after that its a 50 per year to file your minutes and like 38 bucks for the occ. You are required to have WC, GET IT NOW! You can get exempt for 50 but it's two years, not one. If you think you would not hurt yourself get the exempt and find some aflack. Libi is important, with most new home builders in this state you will need at least 1 mill in libi and some require 300k in truck insurance. Look up Nova or Old Dominon. I use Nova atm and pay about 165 for 1 mill. Also in this state we are required to send payments for payroll to unemployment, so i'd suggest... when you get to that point, to get a payroll service to get the taxes and send off to unemploy. Good luck in your venture. What city?

edit : For example AA painting in Jacksonville doesn't exist with the state, so he's a sole and gets taxed personally. Sorry AA, your just the first one I could think of to look up. You do have a spot to reserve that name usage though, some dude in orlando with AA Painting and pressure cleaning went inactive.... you can't have the same name as another in the same state.

edit : Oh ooops, she found it right here... was looking under the wrong name, business since 2005. nvrmind.

well ive got an apointment with a accountannt tuesday, im going to have to go s-corp or llc and then correct occ lic. and exempt with liability, i got a quote for 565 a yr for a 1m/2m policy so thats not bad. im not sure what good my DBA will do me after that tho but atleast i have it for another 5 yrs, lol

im in altamonte springs and here i get both city and county all in one, so its 126 for the first time and i think 100 a yr after that,

with all that, and like many of you most likly i want to say ive been painting too long to switch venues now, alltho i have plenty of other experience i just have too must time in this to quit, and its really not that difficult to go legit, just hard somtimes for cough up that much dough,

i have a guy who is the master at what he does Business services,work comp at untouchable rates hes f----n amazing ,liability ins. you name it anything 2 do with painters coverage he specializes in. You know if you become inc. say an Scorp you can put yourself and three employees under your work exempt a lawyer can draft up a short document stating they have no owner rights or shares in said company. Oh 2million liability seems to be new construction fixed coverage,im hopefully signing with centex homes but finding it difficult to find the capital have everything else and the connection from my sherwin williams rep. reply bak or e-mail me for my guys number j_dpaintingcontractors@hotmail.com

well i have been in the trade since i was 11 my dad got me into it with the airbrush then truck and boat lettering then glass guilding i went 2 mass.art and butera art in boaston 6 yrs college can do everything from hand lettering to awlgrip on boats to automotive finishes just moved to sarasota from boston after divorce trying to make a big name 4 myself finding it alot harder than i expected but if you have any questions i will answer them if i can

Call the local building dept. and workers comp to find out. They changed a lot of the requirements about 2 yrs. ago, a lot of people raised Cain and they rescinded some of them. Also local laws vary a lot in this state, some towns and cities will allow you to work under a county license while others make you purchase theirs.

yea i got the number to this accountant/attorney from my wife's brother inlaw who runs a pretty succesful pest control buisiness... he has the inc and exempt with 3 employees now who are under him and exempt...


o yea it is hard to get straight answers anywhere about what licenses or things you need, with so many ppl going legit now i dont get it why any one person cant answer newb questions,
for example, no one told me untill i went to get exempt that i had to be llc or inc to be exempt. yet apparently everyone knows this.
maybe its their way of making it hard on newb's to be sure some idiot dont start a biz.

about local laws/lic. if i live and have the occupational lic in my city/county what if i go to say titusville to work do i need that countys occupational license too? if so then what if you work all over, does that mean you need to hold every surrounding counties license? i can think of 6 counties i would or have worked in and probably 20 cities
so what do we do about that?
