Subcontractor Agreement


I use this form for the contractors I work for when we have dealings with subcontractors that do not have workers comp, because they have no employees. I have been through enough physical audits where the auditor wants to treat them as an employee, causing us finanical grief. This form clarifies this for the auditor.

Have you actually shown this form to an auditor during an audit, and if so, what was their reaction?

Yep - I actually have, and they were satisfied by this. The fact that the sub is signing a statement saying they work for others as well is what they like to see. I also use a large 3 ring binder and punch holes in the COI's and file them alphabetically which usually wins them over as well. Some auditors are great and some are just real

For the last three years I have had a woman insurance adjustor.
Let’s just say that she is a little hefty and homely.
I always will say things like, “Nice perfume, what is it?” or “Nice shoes, where did you find them?” Basically anything to keep her ass off of my money.
My rates have been more than acceptable for the last three years.


But the Sub Contractor agreement I have is really detailed and basically says that I own them until they are done. I don't think I would sign the same contract should someone give it to me, man I am cruel to the subs, but they seem to like the Dough-Re-Me.

to check their general liability, and it is a least 1,000,000. It used to be that their limits had to match yours, but after talking to the last auditor, they look to see if it is at least 1 million. They can get you on the sub not having enough general liability as well!

Just curious ,are these employee subs, or real subs that actually do work for others ?

Real subs. There have been a few situations where we have used a sub who's business name is basically their name, :ie "Joe Smith Painting" , and the auditor raises an eyebrow because he doesn't have workers comp (because he is independent) .

I do not know all the state laws/guidelines, but I don't see why not. What kind of sub form are you looking for? what do you basically need it to say?
