Trench And Backfill

Hope I'm in the correct area here. I do simple digging for communcations, usually on private property. On a reservation and was requested to dig approximately 30" deep for a 4 inch conduit install, paralell to a new road. BIA installed new box culverts at two locations where ten foot deep arroyos were located. I was requested to go approximately 10 feet deep at the two arroyos. In one section of my install another contractor cut in a drainage ditch over my conduit for future. A very heavy rain washed out 40 feet of my conduit trench up to the arroyo in the same area they cut in the drainage ditch . My trench line is about 4 feet away from the culvert install. Not a huge deal, I'm resetting the conduit and doing backfill and compaction but, I feel the contractor who cut in the drainage should have been more concerned about water shed and wash out at the arroyo. I'm getting blamed and believe it's not my fault since I followed standard procedure (excavated, backfill and compaction). But I have the largest wash out on the property. I say others didn't follow functional grading and either didnt' observe the natural slope and or should have used control blankets or??? Who should have controlled the water? I can give more detail if necessary... Thanks for you answers.

I think they are natural ditches that carry water during heavy rain storms.

Without seeing the site, I couldn't tell you who is at fault. Just fix it and charge extra. You should be putting clauses in your contracts for damages done from weather.
