Nightmare ?
I was reading an article the other day and I cannot seem to find it right now. It was about the Clean water act and someone wanting to change the wording of it. Right now it defines the waters under its control. They want to change it to "all waters" this will mean any water any were in the USA. Mud puddles? footing drains? etc... will all be under the jurisdiction of the Army Corp of Engineers ?
That sounds like a nightmare!

Right now, the clean water act only applies to bodies of water that are connected to navigable waters. It doesn't cover marshes and wetlands. This actually went to the Supreme Court some years back because the EPA was giving builders a hard time related to wetlands and such in their developments. The Supreme Court said that the Federal government doesn't have any authority over water that isn't connected to navigable waters... it's a state matter. For this reason, they're mulling over changes to The Clean Water Act to give the Feds authority over all water. That's it in a nutshell, best as I remember it. This has been being mulled over for maybe 6 or 8 years now.

I hope that wasn't the EPA or the Army Corps of Engineers. I'd rather think it was your state's own environmental people, which is how it should be. I don't think the federal government should be meddling into some pond out in Podunk. Leave that up to the states.

True true, I bunch all those people together in my head. In reality it was this lady that doubled as the health inspector/environmental impact officer. She stopped by and took a bagillion pictures

Yeah, I know what you mean. Somebody has to look out for wetlands and such, but just not the feds. I think some of this environmental stuff is a bit overboard, but if there wasn't somebody doing something, it would get out of hand in a hurry. I'm far from a tree-hugger, but there are a lot of dirtbags out there who just don't care. The silt fence for your fence installation was probably a bit overboard, but there's probably not a good system in place to distinguish your simple operation from somebody who was scraping off acres of topsoil to prepare a building site.

NO NO, Im talkin about vinyl siding on a house. The only dirt that we did distube was to dig two 16" footings for a set of 4 steps into the house

With the population rising and stormwater run off increasing, it is only going to get worse in the future. The problem is, the people that have to pay for all of these rules and regulations are the customers. Eventually, it will get too expensive to build anything.

Not sure who is worse.
Bi**hy neighbor got a board of health inspector out complaining about draining water into her basement. Had to change all the downspouts and els around to make her go away. We had simply replaced exactly what had been there for 50 years. If anything was different it was that we used 2 "B" els turned away form the other property! BTW this was right after a record 24 hour rainfall. BOH lady had never heard of "common law" nor did she care how much rain we'd had.

the corp of engineers are the same folks that came up with the idea of the mississippi river-gulf outlet and the new orleans levees. i think maybe they have their hands full. till they fix these and the many more problems at hand without adding more to their plate.
