I think the stains on the foundation wall are just typical East coast gravel stains, splashed up from rainfall spilling of the roof with no gutters. As for the footings, it won't be hard to sort that out with a shovel or a piece of rebar.

Probably should have grabbed the rebar and shovel to verify footing.
He may have been going on what he has seen as the norm in his location.

But,
He was asked to put in a concrete patio.Say he did this,where the walk out is,then the foundation cracks.
He's the last one to have worked in that area so the blame may initially fall on him for the cracks.

And seeing this in the OP;
She also has her sdr35 sewer clean out sticking up threw her stone driveway about 6".

Makes it seem some things on the job aren't right so he made a judgement call.

were i dick tracy on this job just looking at these pics....it would appear to me with the dirt stain line on the wall, they had only planned on egress windows for lower unit using window wells, decided to make walk out, and cut in a patio door...

I might as well add my 2 cents

I agree with oldfrt, that the job was more than likely done properly when originally built, then someone put in the new windows and either a larger door or a door where there was a window. The mud line looks to me as though there was never a door there and the grading was done to a window in the center. Then there are the stickers still on the windows and door and they also do not appear to have any trim on them either.

I thought this as well when I first looked at the pics but could not explain the fact that there is no mud splashed up on the windows and door.

The operative words here are stone driveway. did you stop to think that maybe there was a concrete driveway or some other material planned for the future and this was left high to accomodate the additional material.

I definately agree with this.
I guess what I was trying to get across is the fact that the finish grading was never completed,leading me to believe it may have been an abandoned project.
A lot of projects were shut down because of the current market.

So, the HO picked up an unfinished home,planned on doing their own hiring for finish,and doesn't know what was or was not done before.
Maybe the previous site work was stopped mid completion because of payment issues or builder's lack of funds.
All I'm saying is OP may have walked into a hornets nest and decided to back off because of a gut feeling from what he's seen.

A lot here are saying he's stirred up a bunch of crap,but don't know how the problems were presented to HO,other than he gave her the Lawyers card if it is needed.

Should he have done further probing? Yep!

But it could have been one of those days that I'm sure many of us have had,where we just wanted to get home.Who knows,he came here to possibly vent his frustrations,and then ask if anyone else could see what he thought was a problem.

Since he's having someone do the probing before he continues,I'd say he's on the right track,and nobody's rep. has yet been tarnished.

Who could come to a conclusion just by looking at that photo?

Never badmouth the other guy, never say the word lawyer in front of a customer, never present yourself as an expert when your "guessing" what another guy did.

I would have felt better about a contractor who told me something was possibly wrong, and then got a shovel to verify it. Now even if he's right he's got his foot in his mouth.
