Be Careful When Shopping


Went to a local big box store to pick up a couple pieces of drip cap. They had it stored vertically on a shelf about four feet off the ground. A piece slipped off and sliced my leg- had to get 25 stitches. There was no lip preventing any of the pieces from slipping off.

Be aware of how things are placed, even if you're just shopping and/or doing something routine. Now I'm out of commission for a couple weeks, can't put any weight on my leg to prevent ripping any of the stitches.

No contact yet. I'm looking into getting an attorney. There was no reason to not have a way to secure them from slipping off the shelf, especially considering how sharp those edges are.

If it's the big orange box, they probably have security cameras per aisle.. Might want to get them to respond soon before the video rolls over.

Here's some from me....

Pictures of the place BEFORE (like you have - a few more won't hurt)
Pictures of the place AFTER (they will manage to install some protection now that there has been an incident)
Copies of ALL medical response/treatment
Names of ALL employess who assisted
********NO TALKING TO ANYONE YOU DID NOT HIRE******

Get pictures of the cut WITH stitches....and after stitches removed.
IF this should goto to mediation/arbitration, you will probably have to go to a photographer of THIER choice for photo documentation of the damage - GET COPIES OF THE PHOTOS THEY TAKE!!!!
Keep a detailed record of who you saw, when you saw them and why you saw them.


Get yourself a real lawyer - not some know it all wannabe on some contractor forum on the internet

It's been my experience that the first thing that will happen is they (big box) will DENY it happened in their store, they will ADMIT NOTHING and demand PROOF from you of this incident....this is basic lawsuit format:
Admit Nothing
Deny Everything
Demand Proof

(in any order, and sometimes repeating order)

....but what do I know?
I'm just some know it all wannabe on some contractor forum on the internet .

Let us know if my format follows "normal" protocol.

Good luck and I hope you don't lose to much time (=money) from this ordeal.

I can see it now, a nice fat check, a quick post on this site on your way to some small island that you will buy. Then everyone on this site will run to their local big box asking where the drip cap isle is. Nathan's membership will all own small islands and this site will vanish--thanks for ruining it!

Thanks for the advice. A friend of mine is a paralegal at a law firm and I will be talking with her on Monday. I frown on frivolous lawsuits but this should never have happened.

You're right about that. You're a professional who is famaliar with the hazards involved with drip edge. You're also famaliar with proper and improper stacking techniques for drip edge, yet you grabbed some off this pile anyhow. Go for the full monty ...hire proper legal counsel - most do not charge a fee unless a settlement is achieved. (and none of these guys will take a losing case )

It wasn't the piece that I grabbed for that fell. If the piece that I grabbed slipped out of MY hands, then yes I am at fault.

MIL collected but had a green atty. They paid for her knee but not her head concussion. The atty didn't include it in the first complaint. I'm sure you know the rest.
