2005 NM Cable, Uses Permitted

Hey guys, Been a while since I been on, I shut down my shop and work for the county now. Which brings me to why I popped in. My Codebook is at work and all I have is my NJUCC blue book which cant answer this question. My buddy called and said his inspector is enforcing ( I think Art:334.12 was where he was asking about, just go to uses permitted under your Romex tab or NM cable tab. Anyway, the inspector is saying romex cannot be installed in the garage (which is detached) unless the owners cover the wall with a minimum 15 min fire barrier. Its a house (single family) and the garage is datached but that shouldnt matter. I cant read the article cuz my CB is in my van @ work and all I have is a Stallcup changes book which does not have anything in it pertaining to that subject. I did tell him under an elevation of 18 inches is a classified location but I need one of you to read and tell me your interpretation of it is. Basically he wants to rough and final wire it and let them rock when they want, the inspector says, if its open he wants MC or AC used, I dint know what do you guys think..... Jim

If this is a residential detached garage being wired under the 2005 NEC, NM cable isn't permitted to be exposed. The inspector is correct. This was a change starting with the 2002 NEC.

334.10 Uses Permitted. Type NM, Type NMC, and Type
NMS cables shall be permitted to be used in the following:
(1) One- and two-family dwellings.
(2) Multifamily dwellings permitted to be of Types III, IV,
and V construction except as prohibited in 334.12.
(3) Other structures permitted to be of Types III, IV, and V
construction except as prohibited in 334.12. Cables
shall be concealed within walls, floors, or ceilings that
provide a thermal barrier of material that has at least a
15-minute finish rating
as identified in listings of firerated
assemblies.
FPN No. 1: Building constructions are defined in NFPA
220-1999, Standard on Types of Building Construction, or
the applicable building code, or both.
FPN No. 2: See Annex E for determination of building
types [NFPA 220, Table 3-1].
(4) Cable trays, where the cables are identified for the use.

Your detached garage falls under number three in this section, since a detached garage is not a dwelling.

I bet I could guess why they changed it too. Did you ever see a homemade storage shed framed up in somebody's back yard with just about every known type of object piled up against the wiring on open faced studs? I especially like it when I see shovels and the blade side of hoe's crimping up on the wiring.

As long as the handles are wood or fiberglass what's the problem?

i thought the corrosive vapors had a lot to do with it. he wasnt happy but it is what it is. i have another thread on here on load diversity, i'd like you guys to give your opinion or ask your local sub code officials. i'm in continuing education for my ICS sub code official license and i have an e mail out to my instructor, i know he's gonna tell me to never go by it, there isnt even a definition in the CB! if you google load diversity you can find mike holts 2008 proposal, problem w/ this job is another electrician didnt take de rating into consideration and now wants to justify pulling 12 gauge, and what ticks me off even more is money is no object and you wouldnt beleive the waste i see day in and day out, and the price difference from the 12 to 10 is only a nickel a foot.....

That code must of came in effect after my garage was built. It is detached not insulated no drywall and you can see all the electrical cables on studs and rafters. Also has a subpanel in it. When opened there is a 20 amp fuse in it. Well actually i blew that 20amp fuse one night and replaced it with 25 amp because thats all i had.
