No Permit Wall


A neighbor next to my rental has built a 5'x6' CMU curtain wall between our houses that faces the street. There is no footer. From what I can tell, he scooped down about 8" and set his first course. Then up from there with 6-8-16.
No return or pilaster and left my gate hanging with no strike jamb.
Should I report him to Building and Safety or let it go ?

How long is the wall? If it fell over onto his side during the night, you may not need to report it.

The wall is only 5'. It goes from the side of his house to the P/L (setback). It is very possible that it could fall over.

Well, I guess it all depends on what type of neighbor he is. Maybe he is decent enough to attach your strikejam for the gate if you ask. Also, you say yours is a rental. Maybe he is a good one to help you 'keep an eye' on things at your rental.

Then again, the wall may fall over.

If you think that you or another member of your family, kids, guest, etc, might be using that gate and the block wall will fall on top of them and someone will seriously get hurt because the wall was installed incorrectly, then you should definitely bring this matter to his attention and tell him, do it the right way or else

I agree with brickie, I'd report him just for the sake of safety. I couldn't live with myself if it fell and injured someone, especially a child. The way it sounds, it not a matter of "if" it will fall, but "when!" If he is a good or even decent neighbor, you might talk to him first about it pointing out what a safety issue it is. Being buried only 8" doesn't give it much support, and a good rainstorm with some strong winds and it will probably go over. I don't know where your at but a good freeze/thaw winter might take it out too.

Glad you posted pics.
If it were me...I would give the guy the benefit of doubt...if he's a good neighbor...let him take it down, at least to the point he can put his own post in the ground..if not that MUST be taken care of. You can't latch your gate now...in a week you won't be able to close the gate.

This is what I would do. The first windy night I would help the wall along to fall on my neighbors side. This way he would figure the wind must have done it, and he might get the idea of doing it right next time. If he attempts to build it again without sufficient reinforcement and footer then call and report the problem to the building department. Take pictures of fallen wall and shoddy construction to document for legal reasons.

The 80' fence between our houses needs replaced. When I told him what it would cost build a 6' block wall, he said he could get it done for $33 LF. I guess this is what he got for $33 LF.

I don't think knocking the wall down is good.

Either tell your neighbour what's wrong with it (maybe he doesn't know better), or just report it.

If you feel he does know better, then report it.

What would you do if you get caught knocking down the wall? What if some kid is on the other side? What if a beloved pet is on the other side? Or anything?

I'm not advocating knocking the wall down. My first post on the subject was to drop a dime on the guy. Having said that, if someone was to knock it down make sure it falls over on Sky's property that way Sky is the victim in this matter

I wasn't directing it at you, it had just been mentioned multiple times

Hook it with a chain and pull it into your yard. Then lift up a few blocks, lay down and put them on your legs and start screaming...
