Taking Possession Of A Vehicle.


A former tenant/plumber/ coke head parks his 2004 van on my property, (where he used to live), with a little note saying it would be picked up in a week. I assume he left it there for the repoer's to find. 3 weeks later it is still there and I left a few messages for him but no returns and he may have left the state or could be in jail for all I know. So I've been talkinig to some recovery friends I know and they think we or I could get this van if we cross the t's and dot the I's. Basically have it towed, send a certified letter to last known address, start charging storage fees, (apparantly the tow fee can be anything you want in Colorado), When the fees come up to the value of the van then you can somehow get tittle. Sounds too easy.

I'm sure the laws vary state to state but i find this pretty interesting. Anyone have any experienc with this stuff.. It looks like I could do this whole thing myself because the keys are in sight inside the van but i'll probably have the pro's do it because there might be some tenant/ landlord law that might get mixed in.

The guy left owing me $800.00 rent last year so I see this as a chance to get that back and maybe some more. I could use a nice van.

Put it in a tow zone or just leave it in the middle of the street.

Go to small claims court and get a judgment for the $800 plus interest.
Keep the van as collateral til the $'s equal out.

Not worth it (from experience), you have to be able to serve the guy in order to get a judgement and if he can't find him to remove his vehicle it'll be even harder to find him to serve him notice of a hearing, plus the costs involved would be more than it's worth.

They can have it after they pay storage and towing. The idea is they won't want to pay. It would probably have to eventually go through auction but from what i understand the guys just bid on each others stuff so it becomes a formality. We'll see.
