Certificate Of Material-Men
I have a new company and just received our first BIG job. Now I am faced with applications for payments. Can anyone tell me how and what to do with a certificate of material men? It says that in the place of this certificate, there can be receipts showed. Are these receipts from the supplier showing that our bills have been paid or what? Sorry, I handle the paperwork and I've never done anything like this before. Thanks for any help!!

A Certificate of Materials is submitted to the Architect and he signs off on it stating that he certifies that the materials meet all standards and that all suppliers have been paid.
In lieu of supplying a COM with the Pay Ap, you can submit a photocopy of all receipts showing paid. The purpose is to provide proof to the owner that all materials and subs have been paid and can not lien due to nonpayment.

realpurty2, thanks. Let me get this straight. So, does the suppliers give me the certificate of material men so that I can forward to architect? Because with it is this form I have to submit and I have to list the suppliers with amount DUE or to BECOME DUE. Or if I chose to submit receipts instead of this COM, can they be copies of the bills I have? I'm confused on whether the bills have to be paid......

It's a paragraph on your Pay Ap that reads something like this:
Certification The Contractor and Architect's signatures below are their assurances to the Owner, concerning the payment herein applied for, that: (a) They have inspected the Work represented by this Application for Payment (b) said Work has been completed to the extent indicated by this Application for Payment, and quality of workmanship and materials conform with Contract Documents (c) this Application for Payment accurately states the amount of Work completed and purchased Materials that have been delivered to worksite; installed; or otherwise now in possession of Owner and payment now due therefor; and (d) Contractor and Architect know of no reason why Application of Payment is not valid or should be withheld. Certified Amount: __________________ (If the Certified Amount is different than the Applied Amount, an explanation of variances will be attached. Intial all figures that are changed to match the Certified Amount) Contractor's Name goes here By: _____________________ (Contractor signature) _________ Date Architects Name goes here By: ____________________ (Archi's signature) _________ Date Neither this Application nor Payment is assignable nor negotiable. Payment shall be made to Contractor, and is without prejudice to Owner or Contractor under the Contract Documents or otherwise. *********************************** To get the Architect to sign off on this, you have to submit your job expenses to him/her, and they review them to make sure you are billing for the amount of work you have actually completed and materials that are now in the possession of the owner. Sounds as if it's part of a final draw for you based on your initial post, so my question is how did you get by without it on the other draws or did you not bill on progressive draw or schedule of values?

My payment application does not have all of that on there. I have to fill in all suppliers and amounts due or to become due. This is our first submittion for payment. Only been on the job for two weeks. Thats why I don't know how to do it yet....Can the suppliers give me a certificate of Material Men? Because I don't even have bills from the suppliers for this job yet. theres been lots of materials delivered and already used, but no bills as of yet... I gotta get this done today..

Are you sure your not asking for a Materialsmen Release of Lien???

What I have is this.........It is a form with blanks to fill in the names of our Material Men and/or Suppliers, their address, trade and amounts.
Then once you fill all this in, under it, there is a NOTE. Its says: The above must be accompanied by a "Certificate of Material-Man". In lieu of such certificate, there may be furnished a written waiver of lien, a written release, or receipt. I called some of our suppliers to get current amounts on materials and they have never even heard of a "Certificate of Material-Men", so they faxed me invoices. arggggggggg.............So, I guess thats what I'll submit with this form... |
