Dilemma


May or not be the right place to post this, but here goes, I am in MN, my boss (the license holder) wants me to build a fence 180' in length 6' high in residential home. No problem except the real estate person does not want to pay for a permit and he has agreed to this (a permit is required), my question is if I agree to do this am I personally liable for anything as I know that a permit is needed or is this all the license holders problem. I have told him that permits are required and it does not matter what a homeowner/Real Estate agent wants the regulations are there for a reason and we should be abiding by them, but he is the boss.

The contractor (liscense holder) will be held resposible for any fines for not obtaining a permit.

Pretty silly though, a fence permit is very easy and cheap to obtain.

Do not upset the Apple Cart. You are an employee. No lives are at risk here. It is a matter of red-tape. Something that is your BOSSES Business and not yours.

Were this a trench without shoring or blocking, it would be ANOTHER story.

As long as you are an employee and not a sub that your boss treats as an employee you are in the clear. Do what he wants and when the town tells you to rip it down because of a lack of permit, you will have job security.

that is what I wanted to know, Malco I know he is the boss and it is up to him but surely I should voice my concerns especially if it may be something that could come back on me personally, this may be just a fence but the regulations are the regulations no matter what the job is. What if he tells me to pull a wire for an outlet, I can do it but is it right no, but as you are saying he is the boss don't upset the apple cart, there are a whole bunch of people who have done what there bosses have said and got in trouble for it afterwards.

I would make a mild statement to him about it and leave it be. Don't make a big deal about it. You tell him, then it's off your conscience. Like Malco said, if it's life threatening, then it's another story.

Even if you are the sub YOU do not need to pull a permit. That is the GC's job. In my area a fence built without a permit gets a $75 fine. end of story, no tear down.

There is no inspection on a fence, nothing to fail, just a permit fee to let the city know there is work being done on the property.
