Cancellation On Contracts


How many of you will give back the HOs deposit. When they call and say they have to cancel the job.After you are already to go contract sign and the job is about 3-4 days out.And what percent do you give back on there deposit if any.

To be fair, you should be entitled to any expenses you incurred, time for drawings you might have provided. If you value the customer go easy on them. Personally I would return 100% if they cancelled within the 3 day right to cancel period.

Had a HOs deck I was going to do.500,00 deposit in hand.they called and said the bank was playing games with the loan. said 9% and then came time to sign went up to 17% when they called and told me this they were real nice about it. So I went by and gave back all 500,00

I have run into this over the years and what I have done (after consulting the lawer) was deduct any out of the pocket exspenses and lost profits. The last time this happened the H.O. did not like it but the judge upheld it.

I just added the word non refundable to my contract. Now, I know they legally have 3 days to conacel, and I think that's the homeowners responsibility. But I knwo that if they called to cancel before the materials were ordered, and had a valid reason/nice enough to me, I would refund it all, maybe keeping enough to cover expenses.

However, if the materials are already made/ordered, or are more than the deposit, I wouldn't refund any, and would make sure I CYA.

I have not changed my contract but I was going to add that 50% is refundable unless permits have been issued then I keep it all. My deposit is 5%-10% and mostly is enough to cover the permit and time to get it. Then I get another chunk to cover materials 3-5 days before I start.

I get a non-refundable $100.00 "scheduling deposit" when a client accepts my estimate. This is deducted from the labor deposit of which I get when I actually start the job. Material funds are paid in full when I start. I am not a finiancial institution.

$100.00 is not enough to cover the time missed due to a cancellation but it helps swallow it a lil better.

Thats kind of my point on deposits its the time I set aside for the job thats now open and may be I cant fill it right away lost days now what. I think from now on I will keep half.for time lost plans break downs.

issued or applied for? The process of applying takes long enough-by that time your time is invested into drawing, application, and all the other stuff, even if the money hasn't been paid out for the approved permit.
