Question About Homeowners Asc.


So I did something I swore I would never do. Bought a house in a HO asc. So heres the deal, the sub is not complete and until a certain % is the builder is the asc. And will not hand it over to the H.O.s. He is collecting dues and pocketing them. I know this is not ethical but is it even legal. I guess according to some he says he is paying for snow removal with it but the streets are public roads maintained by the township. And I guess the township comes in and mows the vacant lots a couple of times a year and charges him, which he uses the funds for that. None of the H.Os follow the rules. Everyone takes care of their yard but as far as trailers and commercial vehicles. Stuff I could give a ***** about. As far as the asc goes everyone thinks it is a joke. I would like to see the whole thing null and void. Mainly because then I would by the lot next to me and put up a barn. Intead of traveling to get things everyday. What do you guys think??

i moved into a HOA neghborhood, we had to vote to thrw out the original management compan. they had set up conflict of interest business contracts for porperty services. they had their cousin doing lawn service, brother in law doing pool maintenance, etc all at higher than market pricing.... they actually had busget forcasts that exceeded their receivables.... it was a pain.

we have had some things corrected, but when it comes down to it it isnt really worth it, so good luck hopefully you get what you are paying for and that is [property value retention

Here, we have specific laws covering HOA's. I'll bet that you do too, look them up.

I'm in my FINAL home and specified 'no restrictions' to my realtor. Got the home that I'm going to die in. Hoa's generally suck, read 'Animal Farm'.

I was working in a subdivision where the HOA decided that they didn't like the garage roofs after the trusses had been delivered for eight garage roofs and two of the roofs had been built, all according to the HOA appoved plans. had to scrap eight roof packages and get new trusses.

I guess in some cases a HOA can be good if managed right, but for me I don't want anything to do with it. When we were looking for another home I told them I wouldn't even look at it if it had a HOA.
I do believe that most places have laws about HOA's and I would get together with other owners and see if they would be willing to help pay to check with a lawyer about what is going on in your situation.

I actually built a deck for a lawyer a couple of years ago. He not his forte but he has a friend who would know. I am going to give him the low down and se what he says. I hate the thought of living there but we picked this up as a repo and when the market recovers we stand to make a nice pile of dough.

That's pretty typical scenario.

When the development gets built out and the HOA passes on from the developer just get together and vote to make the changes you guys want. Pretty easy to do in a small development.

The problem is he is not actively developing. He has started a new project in a town with higher property values. My concern is that it will just sit there and he will pocket the money for nothing.
