I know everyone heard and saw pics of the guy that got shot in the cheek with a framing gun.

I'm not really sure why the nail gun company is at fault for his error.
The jury found that Crutchfield was 55 percent liable for his injuries because he was firing the nail gun into metal rather than wood. He was using the nail gun in an unintended manner and it kicked back because he was nailing into metal. It's a bummer that he got hurt and can't work anymore but I don't see it as the manufacturer's fault. That would be like suing a car company because you chose to drive their car into an concrete barrier instead of onto the off ramp and it caused you damage when you hit the barrier. After deduct Fed taxes & legal fees on that income, he probably still has 1/3 of 3.4 mil in cash pocket?...

Mac, I don't know all the details on exactly what happened.
I know that I recently sat on a jury here where two men got into a heated confrontation and as one of the men was trying to leave in his truck the other got in the way or wouldn't get out of the way and got his foot run over and sued the other. We (the jury) found both at fault and here in NC, no money is granted if both are at fault. It's the law here.

Sounds like BS to me. Someone with 20 years experience should know better than to shoot a nailgun into metal.
Stanley claims that gun is the #1 gun sought after by carpenters, I always thought they were junk. Put a poor fool setting in a wheelchair in front of a jury of mainly women no telling what a lawyer will get. Bet Stanley/HD appeals & wins a reduction. |
