Mortgaged Propery


Anyone ever buy a vehicle and discover the vin didn't match what was on the title, then discover the the seller had two similar vehicles and sold you the one that he owes money on. The finance company has the title to it. You get the title to one he supposedly still has. He "thought" he owed money on the other one, yet he fills in the bill of sale with info on the one he thought he owed money on. He fianally got in touch with me and got me to read the vin on the title I got off to him. Wish I had not done that. I'm thinking he will apply for a replacement title, so I am going to contact the MVD about the situation to give them a heads up. Comments?

P.S I posted this in the Business forum thinking it was business related since I bought the van in preparation of using it in business. I guess others did not see it that way or worthy of responding to.

Call the guy up and tell him you want the money back or the van you have paid off and the title transferred to your name. If he doesn't and you have the title for the other van in your name, call the police, report it stolen and point them in the direction of the guy that sold you the van, might be the motivation he needs to make things right. I buy a lot of old cars so I always check the serial numbers against the title and also get a signed bill of sale.

Got that too whic he also "mistakenly" put the info for the 85 on. I have also worked on the van to get it operational.

With my luck, that would be turned around and be making a false report! I do find it funny how he loses the keys rips the ignitions out of this van and another one he has. I can only assume this one is not stolen as the finance company I talked to has the title to it.

I would say you are the owner of a 1985 van. Unless you can get him to make good on the 87.

Always, check and double check, these are legal documents.
Why would you not check the paperwork till after money changed hands. And to top it off you made repairs on the van you did not legally own.
You may be screwed!

I just don't expect someone do something so blatant as to give the wrong title for a vehicle and fill the bill off sale out for a different vehicle than the one actually being exchanged.

I need not need the van right away, it needed repairs and I THOUGHT I owned it when I made the repairs .

If it goes as far at going to court, I hope the judge wonders why if I bought an 85 I have possession of an 87. I hope he also is stumped as to how someone can get in ahurry and not lnow which of their vehicles they are looking at. I have 2 Mazda trucks. I know one from the other. If I thought I owed money on one why would I give that title to someone for the other. If I owe money on it, I do not have the title and I know that. If I(he) had no idea what was going on, why would I (he) be so hard to get in touch with on the matter?

Inetresting to note that on the day I bought the van I asked him about having lisences for the different trades he performs such as plumbing and electrical. His reaction? " I do a lot of work for the mayor so I get away with a lot of that" Hmmm

Anyway, the way things are in todays world I do believe he can get away with this.

Got interrupted a few minutes ago on my last post. I find it ironic that every now and then you read in the paper about bad check roundups. No I have not ever been involved in anything like that, but I have to think about ppl having to face the music for , in some cases, a small worthless check and then scum can maybe get away with much more serious theft by deception and just rob people. And if a man does what might want to do and may have back in his wilder days it could really snowball and the victim could still be the loser. But at some point some of have to get away from that mentality, because we learn it can hold you back. I have seen ppl stabbed, hit in the head with bumper jacks, for less stuff than this. And I have seen a man dead in a driveway for something similar to this. Now my son wants to get involved and meet this dude and do it the old fashion way. No way will I let that happen if I can avoid it. The longer it drags out, the more apt that is to happen. So yeah, I may have to leave it alone. I mean I would never wish harm to anyone..in a puplic forum .

Well don't let your son get involved and solve this "the old fashioned Way"or

Have you talked this over with the seller?

Maybe he is trying to pull a fast one, or maybe he has made a mistake.

As it sits, you have a van you don't own (legally) and the bank which has a lien on it can come and repo from your driveway if it is behind on payments.

The 85 which you own (legally) can be sold to someone else if this guy gets a replacement title (which he can because you have not titled it in you name). and you could be left with a few pieces of paper and a court date if you wish to pursue it.

I would get the 85 at my place and keep the 87 also till this guy makes good.

I hate when crooks pull this kind of ****!

Funny how sometimes ppl will say or do something that might come back and bite them if anything was to happen that can be tied into such statement, action, or inference. Let me say now that statement was not meant to insinuate that I speaking with a forked tonque.

First thing you need to do is call your attorney. You may be sitting on a stolen vehicle for which this fella planned to do a flip on.

Clues:

He has an '85 and an '87.

Only seen a title for the '85.

KNOWINGLY sold the '87 with wrong title and money still owed on it. (may not know about the money owed)

Needed some sort of title to give you to get money out of your hand.

You get title to the '85.

Anyway, I would get ahold of an attorney, and then the police. You may be the proud new owner of a shiny stolen vehicle!

Don't ask how I know these things.

Update: He just left. Supposed to bring more tomorrow and bal by the end of the week per written and signed agreement. Not sur ehow good that agreement is, but got to try and get as much as I can back before it gets any more serious. Just have to wait and see.
tgeb brought up some points I was already aware of, but seeing it in print really got me going!
