Lawyer-up Or Go It Alone?


Got rear-ended the other day; van totaled;some injury ( whiplash, possible shoulder fracture) had x-rays, mri, and PT. Clear -cut case- other guy 100% at fault.
Anyway, not sure if I should get a lawyer to handle this for me, or deal with the insurance company myself.
Anyone have a similar experience they care to share?

There is no such thing as a clear cut case, get the lawyer, let him do what he does, do you think a lawyer would try historic woodwork restorations because it looks simple and he saw it in a magazine or on TV?

Whiplash is hard to prove or disprove since it is not visable on an x-ray or MRI

The only bigger fool than a man who represents himself in court is his Attorney. Get a Lawyer.
I was rear ended by a DUI in 1972, settled out of court for $1,600. I have whiplash, muscle spasms and back trouble that never went away.

Insurance Lawyers are against you. Do you think that you can beat them?

DO NOT get a paper pusher Lawyer. Get a LITIGATOR and take this ALL THE WAY.

Might take 5 years, but you WILL get 100's of 1000's of Dollars more!

I know. I am a Recipient of a Massive PI settlement. It ONLY took 13 years.

I agree with the others - Lawyer up! Many will work on a contingent fee in a case like yours, or at least a small retainer up front, so don't try to save a buck and try to represent yourself. The insurance company lawyers will shred you if you let them. There is too much at stake.

Also....his insurance company and their reps are going to be looking for you really fast trying to get you to sign stuff, make statements, etc., etc.

Talk to no one, sign nothing, become invisible until you have representation...which you will have tomorrow morning right?

thanks for the input, guys. I'm not sure the BI is that bad , and what the case is worth- but who knows? Anyway, I've checked out a couple of law firms.
really was looking for comments by people who experienced similar, and what happened to them.
btw,my father was a claims adjuster so I have a little insight into how insurance co's operate.
It seems that when these kind of cases get litigated they take a long time.Did you say 13 years, Malco? At what point did you determine the extent of your injury?

#1. Long story short, I got t-boned, got checked out at the hospital, saw a lawyer, never got any more medical treatment, got a small settlement in 3-6 months.

#2. My wife got hit before we met, settled for a small amount and has been going to her Dr once a week or so for the past 15 years, whatever she got does not cover her time or medical expenses.

#3. I know a lady who is waiting for settlements on 3 or 4 different accidents, none were her fault she somehow attracts other cars. She has to work a crummy retail desk job until the money can come in.

Hey Mike........What I said to Eastend was for the purpose of getting his attention so that he may reassess his course of action. There was no "fight". When you started with your retort is when the POSSIBILITY of a fight commenced. So yes, you started it.

Anyhow. Never called the OP stupid. I said that he asked a STUPID question. A REALLY STUPID question.

Never insinuated or assumed that you proposed a personal beat down.
