Re: Whole Website Stolen

I always feel uncomfortable referring something I do not have personal experience with.

If this Copyscape, did not provide a free method of checking things out, I would not have posted it on the board.

Re: Whole Website Stolen

Thank you all for the input! I did a whois search, found the host, and sent them a DCMA Notification according to this http://straylight.law.cornell.edu/us...2----000-.html
DCMA (c) (3) (A) (i-vi) format.

The offending site should come down quite quickly now I hope. Just changing one page is not going to cut it.

I found 4 offending websites by using it.
The free use is only once a month and great, but pretty cheap to buy.
I think I will buy their software.

I win. Just got a fax from the 1and1.com's attorneys. 1and1.com is the site hosting the stolen items from my website, so I contacted their legal department with a DMCA notice, and the all of the pages have been taken down!!!!!!!!!!!!!!!!!!!!!!

If you guys have trouble in the future with this same issue contacting their web hosting service seems like it will do the trick.

Re: Whole Website Stolen

It's too bad they took the sight down it had some great pictures and tips, I'm kidding. I don't suppose I have to say how I feel about people doing this. It amazes me how common this is, I wonder how they'd feel if you walked into the offenders house and helped yourself to their property.

Bone Saw,

Who was the guy in Illinois, I'm curious, there are several deck builders in my area that have pictures on their websites that you can see things like palm trees and the ocean etc., that are clearly not there own.

Re: Whole Website Stolen

Hey AA, where on that page is that DCMA Notification? I have an issue with another contractor using one of my project photos right on their home page, and they're even in the same County as I am ..
http://www.conquesthomeimprovements.com/

I've emailed them twice so far, no results. Actually, I'm used to people stealing and using my images, but it would be nice to have some sort of Legaleeze to send them.

Re: Whole Website Stolen

Damnit man. I hate thieves as much as liars. Anyway, here's the format you need for a DMCA notice. Send it to their hosting company. They will either have an abuse department or a legal department to mail it to. I e-mailed mine. Here's the format. Some places might require an actual digital signature, I just took this and filled my information below each heading so there was no question what info was provided.

Quote:
DMCA section (c) (3) (A)

i.) A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Adam N. Austin

(ii) Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.

http://www.aaqualitypainting.com/about_us.html

http://www.aaqualitypainting.com/interior_painting.html

http://www.aaqualitypainting.com/house_painting.html

http://www.aaqualitypainting.com/pressure_washing.html

http://www.aaqualitypainting.com/concrete_staining.html

http://www.aaqualitypainting.com/wood_care.html

(iii) Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material.

http://tampahousepainters.com/about_us.html

http://tampahousepainters.com/interior_painting.html

http://tampahousepainters.com/house_painting.html

http://tampahousepainters.com/pressure_washing.html

http://tampahousepainters.com/concrete_staining.html

http://tampahousepainters.com/wood_care.html

(iv) Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.

Adam N. Austin
5291 Collins Rd. #337
Jacksonville, FL 32244
(904)622-8466 Business Line
(866)338-7926 Fax Number
Aapaint@aaqualitypainting.com

(v) A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

This is my statement that I, Adam N. Austin, am the creator and sole owner of the works mentioned in this complaint that have been copied, and the manner of use is NOT authorized by me, the owner of said material. My copyright info is still on the bottom of some of the pages listed above with my company name, including my company name being easily found in text that I wrote that has been copied without my permission. There are no agents with the authority to authorize use of this material other than myself.

(vi) A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

I, Adam N. Austin, do hereby declare under penalty of perjury that I am the owner of this material, and therefore authorized to act in interest of this infringed material. I hold the exclusive rights to this material, and have given NO authorization of any kind to any person to copy my material.

Thank you kindly,
-Adam Austin

Thanks Adam, I'll be using that today. I've also shown that to my webmaster since he has the same problems with a few of his websites.

Hi AA, may suggest to you and to anyone else who's a victim of copied site text a much more effective gorilla war style tactic should contacting the host fail. I'm glad to hear contacting the host worked, but if the offender runs his own server you'll get no luck that route.

The copied site's IP address is: 82.165.131.38

in MSN you can query an IP address to discover other sites on the same server. So we see this..

To do the ip address at msn[DOT]com type in the search box just like this example: IP:82.165.131.38

Look at the results and now it's here that you have to be a detective and poke around and look for connections and hopefully get lucky. What you're trying to find is another site on that server which was created by the same person/group who copied your site. If you can make that connection, then look at a client site and google THEIR text. Google something that looks to be unique. Guess what, if the scumbag launched a site with copied text, chance are he does it all the time. So I bet you'll find other examples of where he/she copied text on other projects.

The next step is obvious.. contact the other site client, because they are a victim too, and let them know their site has copied text and give them proof. Make it an email and CC this guy. This will bring a fast close to getting the copied site down because you'll create such a headache for this guy. You'll cost him time and money and that'll get his attention. Let him know you'll keep contacting any client of his who you have proof that he copies sites and this will go away in 3 seconds.

Be a fanatic about protecting your site copy. It's more valuable than you think. I would routinely google specific phrases that only you have written. Put quotes around the search too and be on the look out for this kind of thing.

It's your copy that makes you unique in search engines.

All the best,
Jeff

Re: Whole Website Stolen

One of my competitors. He got ranked ahead of me on google on your hard work. sigh.... He advertises Behr paint on his exterior page. lol

I use templates and keep the link back. I have also taken some pointers from some of your guys websites and incorporated them into mine but to blatantly take someone elses entire site or even any content is wrong.

Every painter in my area ranked ahead of me has cheezy lookin sites. You think google would put looks into their algorithisms.

Re: Whole Website Stolen

Are you saying there is another one, or were you talking about this same guy? I'm sure he got ahead. My site is optimized, and has cost a lot of money to get to the point it's at now.

Why can't someone local do that? It would be SO much easier to deal with.

Joe I have an idea for you on the pic put "designed and built by (your company name).

And what else you could do is call the company and ask them how much they would charge to do the same thing to your house as in that picture and see what they say..then tell us

Same guy. I just now read the post.

Guess that is the easy way to optimize huh. Steal someone elses site.

I am doin my site all by myself. It may take a bit longer but I will still get there.

Re: Whole Website Stolen

I had this happen about 10 years ago when I was running a dot com. I was a retailer, and built my site from scratch with Notepad. I built a really nice table comparing products. Building a table by hard code is pretty tedious. Some <expletive> STOLE my table and put the thing up on Ebay! I was furious! She didn't even go into the code to change color codes! I sent her an assertive email and she took it down, and I never saw her reappear as a product retailer again.

If you're placing well organically in the search engines, you need to be particularly vigilant. That Copyscape tool is great.
