Warranties

I finished a basement for a customer about 2 1/2 years ago, with a full bath, and apparantly the drain line for the toilet has a slight uphill flow to it, resulting in 1-1 1/2 inches of water sitting in the pipe. I know that the toilet drain line is only about 4 feet long before it connects to the T where the shower and sink merge. I have seen a "snaked" video of the drain and everything else looks good except for the 4 foot piece connecting to the toilet. After looking at it, talking with my plumber (different than the one I used on that job) and seeing the video, I don't think that it is imperative to replace to achieve a downhill flow. With that said, here is what I need to know. I did not give the customer a written, oral or implied warranty on the project (although I do now on every job), since I did not give any type of warranty, can the customer sue me be breach of contract/warranty, even though there wasn't one?

You have got to be kidding me? You can see there is a real problem and you do not what to fix it? Do the right thing here and fix it and be a hero and you will get more work from it plus you will be able to sleep at night.

I second that thought.

Always contact your attorney for the only legal advice worth listneing to. In this case, I think he would tell you the other guys got a good leg. You could spend a lot of money on this.

Or you can say oops, I goofed and fix it. For purely selfish reasons of course, it will help get more business in the future.

Or just because it's right.
