Using Pictures Of Work On Website??


Last year, my company completed a tile job for a customer and I took pictures of the completed project and posted it on my company website. I just received an email from the customer telling me to remove the photo. The photo only shows the tile, nothing else. There was never an agreement to not take photos or anything of the sort. When taking the pictures of the completed project she was told that they would possibly be used in our company portfolio. Do I have the right to post my work on my website or not???

All input would be appreciated.

You can use it in your
physical portfolio.
You can't publish it
without the HO's permission
on a signed release.
Putting it on your web site
is publishing.

Next, put wording in your contracts that clearly state that you will be using pictures from project to show your work.

Thank you for all your replies. I never did get the HO's permission in writing, it was verbal. So I will just remove the picture to avoid any confrontation.

If you Google "photo release/waiver", you should come up with some boilerplate releases that you can modify to suit yourself.

You took pictures of your work, not theirs If they hadn't given you the final check it wasn't theirs yet. That would piss me off, having someone say that you couldn't show your own work off. Put it in your contract. Take the picture down and give them a real stern look.

Have you asked why, is this a place that hosts lots of parties with a one of a kind tile job? Are they unhappy with you for some reason? Follow through my man, follow through & get that clause in your contract

Could they be unhappy with you, and not want to give you any endorsements of any type? If there is an issue, you need to talk to them, unless you already know why they are being uncooperative. If it is for privacy reasons, they would not have given you an OK to take pictures to begin with.

I would take the time to see why they were in your website, as well.

Yeah, sounds like they are digging for information... (being on your web site and all).

Also, whos to say you dont use that tile on multiple jobs.. How do they know its their tile being published to begin with???

I think they're upset with you and you need to find out why, asap!..

i have each home owner sign this ARTICLE 12. PHOTOGRAPHS Contractor has the right to photograph the work area before, during and after the proposed work. All photographic documentation becomes property of the contractor which may be used for marketing or website distribution with owner approval. No personal names, addresses or items will be displayed without written consent of homeowner. Upon signing below, I agree to allow *** construction use photos of my project. Dated: Signed: Owner

Pictures and video taken from the street or sidewalk (public) areas is completely fair game.

You do not need any one permission to take them and to publish them as well.

However being that the content of the image is a client it is "nice" to let them know you are going to use it to showcase your work.

Now if the content is created on private property you must have permission to use it.
