That Tile Sub I Fired Last Week


Last week I fired a tile sub. He agreed he could not perform the job. I told him that I am willing to pay for the couple of things he performed correctly. But that I need the rest of my deposit back less what he installed correctly. And, that I would have to back charge him for the demolition work he created for me and the cost of materials that he ruined by installing them wrong. Roughly $2700 total. He seemed fine with that and gave me some money and tells me he's got more for me tomorrow.

My question is what sort of form or letter should i create to acknowledge that these events occured?

I'm no lawyer or judge, but I would think it would be proof enough that he handed you a check (make sure it's a check and not cash). But it's not like you're withholding payment or partial payment....HE is freely offering monetary compensation TO you for damage caused.

A backcharge notice and lien release waiver should cover you along with the copy of the check, you shouldn't have a problem if he agreed to pay. A letter to the sub with a company letterhead would be the minimum, with a lien release of course. Sounds like your sub was unqualified, have you checked his references and/or seen prior work? Hope all goes well.

Definitely get a lien waiver, don't ask him for one, give him one to sign on the spot.

Also you should be keeping a daily report with all that has transpired in it, that too is a legally binding document
