Sweet Job Going South


I sold a sweet job back in march a 44' front porch with a paver walk, trex decking fiber rail hand rails rear deck 34' x 14' with steps with same spec, and a room addition22x20 A/C in the hole house the job is around 100gs I feel its a fair price.I get a 2000 doller deposet 2000 for plans 800 to pull permits I set a start date of june 8th . I had the job marked out today . When i went to check it out the HO told me he has two other bids and is wating for a third? How about telling me? . Ive been turning work away for two months it takes me 5 or 6 weeks to finish a job like this one and i have two more after this that cant start early because of zoneing and planing board meetings. The HO asked me to wate till monday to start .He must have started passing out my plans? I want to tell the guy to stick it ! I have some jobs that i could start in its place but im not going to make the same money. I want to flip the plans in the trash . I have a bad feeling on this . Who would try to save the sale? give the HO his money back ? yeah right .

That blows.

3 things:

#1 Bigger Deposits (10% would have equaled $10,000).
#2 Contract.
#3 Non-refundable deposit clause in your contract.

Start creating an invoice for your time involved in the project. That should include the time you spent talking to suppliers, doing the math, coordinating with subs, drawings, and communicating with the H/O.

If he bails you can show that the deposit was paying for the process of starting up the job.(by the way, it is)

Disgusting!

If you can demonstrate a verbal contract existed...

And, if you can document that you turned away other work based on this verbal contract...

Then you may be able to recover your costs to date plus your anticipated overhead and profit for this project in court.

Contact a construction attorney immediately!

Im still feeling down low. I have a hard time selling if my mind is not right. I have a few leads to see on saterday one is a small addition .They have plans and Its in my town I can pull permits in a few days .The jobs only 40 gs but its a start. I have a good contract and i do have 58 hours in . but I mite be better off trying to dig up new jobs .I mite be better off not doing the job the people are a little crazy .I just cant let go of a lead. I like to email back and forth so there is a log but the HO did not use Email . . I have a much harder time geting 10% down when i close a job . easy come easy go

No refunds! Did they ask?

Well, at least you got $2800 from the customer.
How did the meeting go when they forked over the deposit? In hindsight, was there some lingering doubt?

Do you have a a copyright symbol on your PROPRIETARY plans? Tell the customer about the $5000 fee for subsequent use of your design plans and intellectual property. Blow some smoke.

Do you want this deal?
Are they being jerks about it or just plain stupid?

If you keep it, I'd demand substantial draws as you progress(In writing). Don't know if I'd want to finish or not, but if you do, whip them into shape.

If they gave you a deposit for permits that is a verbal contract for starting the job. Good luck on this one, check your state laws regading verbal contracts.

If you got a deposit, they must have signed a contract, no?

If not, WHAT THE HELL ARE YOU DOING?

I don't install a bifold door without a deposit and a contract and you are walking around fooling with $100k plus jobs? Dude, I feel bad for you, but WTF?

Well the people are hi on the stupid crazy scale but I did come up with a great job for them at a fare price .I pushed the close but i wanted the job and i thought they where ready . I have a great contract and every one sined it after i read all the small print . They gave me a check. I did not talk to them for a few weeks but i did not feel i need to .The job is a lot of work for the money and it would be hard to beet my price .I was thinking it was 5000 low because i did not rase the price for fuel or roofing sideing ect, but to add hard wood flooring ,paint , small 4x10 foyer with closets and a brick wall and floor in the famly room for a wood stove plus a casment window up grade in the addition ? I would love to see the bid. its sounding like a extra 20,000 plus . If i dont get the go ahead on monday i will be out of time my next job starts on augest 1st and i need 6 weeks to build this job . I mite drop the deck in the rear and build it later?

If you have a signed contract then what seems to be the problem? Do you have a cancelation clause as already mentioned?
