Subs
I was wondering....for those of you who use subcontractors. How do you pay them? What paperwork do you need and what requirements need met?

However their contract I signed to autorize the work, states they get paid. They tell me, I'm not their boss, I'm their client.

Some things:
1.) Proof of insurance must be submitted prior to the start of the job. No insurance = no worky. 2.) SS #, FID #, mailing address, full company name etc, before work starts. We do not want to have to be chasing them down Jan. of the following year to get their tax info. Besides, we want to make sure that they are "legal". 3.) Sign a subcontractor agreement. Basically stipulates that they will not pursue our customers without permission. Violations would be grounds for immediate termination of contract, regardless if the job is finished/unfinished. They also may forfeit the remainder of the job payout, under such circumstances (that they create). 4.) Determine the payment schedule. 5.) We pay by check. 6.) We make them wait one year, before we make the last payment to them, (It's only fair) because we want to make sure that the job they did is not going to have any issues later on....Oh, wait a minute, I thought I was a Home Owner for a second... Actually, we pay, when the job is done. They should never have to wait for a check, if the job is done.

If they are a subcontractor (Separate company), they have a right to wear their own shirts.

I'm not sure if it's legal or not but I would have to think yes. If a person can wear any name brand clothing while working, why not wear a shirt that you gave them. I may wear a shirt or hat from a supplier but I don't work for them. I would think the same goes for you and your shirts. But I'm no expert on this.

I believe that it is completely legal.
However, the gray area falls into play with insurance coverage (WC) and charges. The old arguement: "Are they subcontractors that work exclusively for your company, and wear your uniforms? That sounds like an employee...."
