Pre Contract Contract

What do you think of this for the one doing big bids and small companies..

Pre-construction Contract Agreement
Name
Address

Customer
bla

Enter into this contract that shall supersede all prior communications and agreements and there are no other terms outside this contract.

The contractor, using standard bidding practices and specifications determined by the customer will compile a comprehensive bid to complete the construction stated in the specifications.
The bid details relating to cost as determined by the specifications will become the property of the customer upon full payment to the contractor, all employees and sub-contractors of the contractor have entered into an agreement not to work for or price independently, work relating to this pre-construction contract or on future construction contracts with out the consent of the contractor. With this in mind the customer agrees not to contact or hire these workers without the consent of the contractor.

The customer agrees to pay the contractor the amount of $500.00 or 1% the total bid cost of the project including GST, which ever is more. An amount of $500.00 will be paid to the contractor upon acceptance of this contract.

The contractor will:
Supply comprehensive bid
Administer the detailed specifications list
Maintain ethical bidding

The ultimate goal of the contractor is to produce a product the represents the customer’s wishes at a fair price, in a realistic time frame by qualified professionals. And to enter into a construction contract to produce this product.
