Partnership Vs Employee

An unlicensed contractor wants to use my licensed contractor status on a job he is responsible for ... should I try and partner with him or become an employee of his company?

Do you have **** for brains? Have you searched and read about this in forums?

Having someone work with YOUR license, the thing you are responsible for, studied for, got insurance, etc to someone who doesn't give a damn, skirts the laws, doesn't care about you, etc is about a stupid as going to the whorehouse and running bareback...would you do that?

Re: Partnership Vs Employee

I think maybe you've got it backwards- HE should be an employee of YOUR company- not the other way around- and you should hold the contract and receive the profits. Why on earth would you want to let someone else use your license? You take all the risk, and they get all of the rewards.

Make him an employee of your company. After all, you as the license holder are responsible for the problems that could and will arise

Re: Partnership Vs Employee

Unlicensed & contractor should not be linked together. Licensed contractor should have control over project & a greater than equal share of profit. Unlicensed is a jack leg side jobber. In my company's beginnings, I worked under another license while waiting for an open test date, absolute control went to the license holder. They didn't want any of the profit, just a small fee because they were helping me to get going, quickly as could be my license was obtained. I was insured from day one, a quirk in the insurance regulations I guess.

If they are just starting out & you don't mind their competition, go ahead but keep final control, if they have been at it awhile, do us all a favor and send them down the pike.

First of all, smack your hand with a hammer and think about it for a minute.

<goes for coffee>

Did it hurt? Did you know it was going to hurt before you did it?

Now, consider for a sec, how is it that hitting your hand with a hammer is in any way dumber, less risky, or the outcome of which more predictable than letting someone "borrow" your good name, and your business?

Would you rent out your truck to a crack head?

Re: Partnership Vs Employee

Thank you for the great responses. All the opinions support what I have been feeling, but didnt' have the experience/confidence to express. It really helps to have insights from a group of individuals who have "been there, done that" and will tell how they feel about it!
