Re: Off To Court We Go...

Sorta sucks, but this happened to me once in 1994, and once in 2005. "I don't remember" is a good answer to most questions. If I'm being paid as an expert witness, I might remember more stuff.

That's some good advice.
Thanks; It might be best to be honest, but not over-anxious to offer advice in situations like this... I think I have one coming down the pike in the next year or so... same situation about fixing someone else's work...

Re: Off To Court We Go...

Forgot to mention that all the "fix and repair" work was done according to the structural engineers notes. What frosts me is here we have an illegal
contractor, not licensed, didn't pull permits, screwed up, was fired, and now is saying "It was my project, I should have been allowed to complete it and get paid!". Bizzare...

In my experience, when people get desperate, sanity takes a vacation. That's why I go through the hoops of doing a background check on potential clients to see if they are sane mentally and financially. Once did a check on a client, and found he had 12 liens placed in the past 2 years on his house, all from contractors.

Re: Off To Court We Go...

been there twice under different circumstances. Homeowner hired someone else to do the work but I had to testify about the problem that required the work in the first place. Don't show to testify, go to jail.

Just remember, these rules are written by legislators/lawyers who always cover their own a*ses and ***** everyone else. You can thank your democrat neighbors for electing these guys and making sure the trial lawyers of America are fat and rich.

Law says '"no court will hear a complaint to be paid from an unlicensed contr. " Not actual wording ,but close enough!

Tell him good luck finding parking for under $25+ for the day. Don't forget the tolls for the ride into town.

Re: Off To Court We Go...

I was in a situation where I got to be called as a witness for some bull crap frivilous law suit against my land lord's insurance. Anyways it was a few years after the fact and they had been trying to serve me for a year and I was able to dodge.

I wasn't of much help when Is howed up to testify, because the so called victim was trying to pin the problem on one thing but it was caused by another and since I didn't want to be there I refused to be of any help. When they closed, and while still on record, I was asked if there was anything I wanted to add... and OH BOy I went off. "This is Bull crap, wasting my time... I am out a day's pay, parking in downtown chicago costs more than this $17 check you gave me. If you want me to testify again you'll have a hard time finding me."

Anyways one of the lawyers gave me $20 bill and made me sign a reciept. LOL

Re: Off To Court We Go...

Talked to the contractor last night, he got "Served", which was a scary
experience. Seems the process server went to his house, pushed open the door when the contractor's wife answered, and barged in looking for the person to serve the summons to. In MA it doesn't take much to be a process server (some have criminal records, no backround check), and some can be "over the top" when it comes to doing their job. And in MA the only way to get out of being served is to be dead or near death, and that won't stop them.

Wonder if some process servers are related to "in snow, hail, fire, the mail will be delivered" postal workers?

PS told the contractor it's time for a few counter law suits.

Parking and tolls wouldn't be a problem after that....they could just bring me from the holding cell. I would have served him up an arse whooping in the 1st degree for that stunt. Don't mess with a man's castle.

Well, it had to happen, talked to PFF the other day, and the illegal contractor, RT has filed suit against PFF as "he took away work that I was
supposed to do". As Laurel & Hardy would say "Another fine mess you have gotten us into!". Might as well sue all parties at this time, I told
PFF.
