Question

Maintenance Period


Just a quicky! I need your advice so to speak.

I have just completed a job and over here in a HIA Contract we give 65 working days as a maintenance period to any defective items for us to fix etc.

Now the owners have told me that there ae a few small things to fix and we both ageed for them to give me the list towards the end of the maintenance period which by the way ended afew days back.

What should I do? What would you do? Should I say give me the list anyway and we'll fix the items. Or say bad luck, I'm not touching it as per our Contract.

What do you reckon?

fix it anyway. you know there were things to fix, do the right thing, call them, then fix them.

Thom,

That's the thing, I don't exactly know what they what fixed cause they have not produced a list. Maybe I write them a letter to say the maintenance period is up and then wait for their response.

Yeah shaw I want to do the right thing by them and everyone.

I'd have them send you the list before you decide to tell them to go scratch. The items may be minor, and fixing them would be good PR. I'd make sure I gave them the "bear in mind that you're outside of the warranty period, but we want to take care of this for you anyway" speech, so they realize that you're going above and beyond what you need to do.

Yep. What about if an item in that list is a major item such as replace a tiled floor for example. What would you do there?

See I don't know yet, but as you say Bob, I'll wait for the list,,,,, if any.

I would have no problem adressing the issues, AT MY HOURLY RATE. You wrote and signed a contract for a reason. They were aware of the time limit, and missed it. Maybe this is a little hard-nosed, but I am sick of people trying to squeeze me. Chris

So you'll loose a customer wanting a few small items repaired, that they notified you of earlier, to make a few extra ??(what ever you currency is)

You'll spend more advertising.

They have not notified me of anything. Just a list?? That could mean anything! Em I right?? Eh? Do you know that the items are small? I don't, how do you?

Mark!! They said there was a list of items, but WHAT items. I have not seen any list. That's what i'm saying.

See what people say is DIFFERENT to what people record in writing. Your contracts must be similar. Surely!

Booga, even if they are beyond the 65 days, it is worht it to fix small stuff, if only to bolster your reputation. If it's something bigger, like replacing a tile floor, would that not come under your warranty? Or is your warranty only 65 days?
If it is warranty, seems to me that should be at lerast a year anyway.

LAst year a customer called with a rotted board on a deck I built about 10 years ago. I had a job down the street anyway. It cost me 1 board and a 1/2 hour of my carpenter's time to fix it. When the customer asked how much, I told her to make a donation of whatever she thought was fair to the Heart and Lung Foundation.

That is smart business. They probably won't shop next time.

Booga, If they said a few small items then I would assume they are a few small items?
They seem to feel comfortable enough with you to not rush?
If they send you a laundry list then respond appropriatly.
I don't see anything that indicates a problem unless their is something you didn't put down here.

You knew some punch list was coming, you asked him to wait till near the end of the waiting period. It appears that you were notified during the 65 day period that you owe him some repairs. Nothings stopping him from adding to the list until you get there to inspect the work. I do not see how you even have a question, unless he notified you of issues past the 65 day window.

A good PR move for you in the future would be to make a courtesy call near the end of the 65 days, and remind them of the impending deadline. Then if something comes up later, you can refuse to do the work under warranty, and feel justified.
