Lien Wavier , Please E-mail To Me


I understand what a lien waiver is, but please e-mail this one to me


Currently, im doing a commercial space where I have 4 total payments to me.
deposit, 25% 50% Final

Ive collected my first check, theres a change order $4700 , i need to complete this stage before i can get my second check.

Ive submitted the change order for 4700, hes ok with that and asked me to sign a partial lien waiver for payment 1 and 2?

Im not exactly sure how to handle this one.

If he wants you to sign a lien waver, the only thing you need to ask of him is where is it? Why would you supply it? Why would he want you to?

If he isn't sharp enough to understand he should be supplying the lein waiver since it's to his benefit, just scribble on the inside of a Mcdonalds Big Mac wrapper "I got my money, I won't place no lein on U"

Man you guys are tuff at times. We need to supply lien wavers all the time. Even our retail clients request them to.

In Florida anything over $2500 you have to file a notice of commenment at the clerks office before you can get your permit. This is signed by the property owner.

Any supplier that delivers product to a job site files a notice to owner. This is mailed by certified mail to the property owner which is a BUYER BEWARE NOTICE. This means hey homeowner I supplied material and I have not been paid yet.

This is all good for us because it protects us all. In our legal system here in florida as long as you do all of this you are going to get paid and so is all your suppliers.

We get permits on every job and we have a staff of 4 employees that make this all work.

So yes Mike and the gang I would love to go to McDonalds to get my waivers and thing god for that drive up window.

Just to be sure, you are signing a lein for the $4700, not for the remainder.
I had someone try the "paid in full" on me once.
Like Mike I use the conditional release, and have 2 different lein wavers.

In regards to leins, I attended a full day seminar on leins and wavers for Minnesota contractors. The course was taught by 2 construction attorney's.
I left with a binder covering most situations I could safely handle. Lein laws are complicated and vary state to state. When in doubt call a lawyer who understands your local laws. I have a guy who charges me $150 for 45 minutes when I can't comfortably understand the ramifications of what I intend to do.

It is Chicago Title Company, but you may have a Title Company that is local to you that you can use.

Always write in;
"Only Valid Upon Reciept of Payment and the Check Being Valid and Clearing"
