Thanks, the lawyers are a little slow on the paperwork end of the deal. We are hoping to finalize Mon-Tues. We will accept our 80% and yes, i believe he is under a lot of pressure to make this go away.

On another note, we visited the bar where his new painter frequents. He was certainly surprised. Let him know we were not happy about his stepping in on our contract. Typical new company just looking to get screwed. His rates are almost half ours and you know at those prices, someone is likely not getting paid. I am guessing the government.

Is this a painter thing? This protocol does not exist in the electrical business.

Handled well. That GC makes it hard for everyone. If it weren't for a-holes like this GC we wouldn't need contracts, but please execute a contract next time.

When you put together your contract next time be sure to put a "previaling party clause" in it...this clause basically states that if you do have to go to court the party that prevails and wins the court case has to be compencated by the other party. Oh yeah, make em pay!

And add "any legal action taken will take place in the county where I live, because that will increase your cost and make you pay more money when you loose when I haul your sorry ass into court. " Or words to that effect.

I will update our contract and begin enforcing. The funny thing with this contractor is we had done new res homes for him and although they were a pain, we had always received payment. He does have a few spec houses that have not been selling and I feel as if on this larger project he may have been trying to pull a cash grab but I could be wrong. Anyways, we are moving away from the new res market into more profitably work. I am pleased that this relationship is over.
