How To Contract With Condo Association?
I searched the wisdom of these forums and I didn't find this yet...
What is the basic process for contracting with a condo association? Do you specify a key person as a liason, or just the name of the association? Or do one of the members become legally responsible by the contract? I'm giving a proposal to a small (3 unit) association for a front porch rebuild and I never worked for an association before. |

Karma I have done these in your area. I found the best thing to do is get all three owners to sign your contract or you could make a form that they all sign giving one person the legal right to sign for all of them. A lot of those small condo associations don't have officers in there associations. I have not had a problem with any of them even when I just contracted through one owner. Good Luck!

Thanks for the advice Ric. That's probably what I will do - either have all three sign, or have one sign and then all three sign a paper giving that one the right to contract for the association.

This is true for all associations or commercial projects: On the top of the contracts it states the association or company name, then the attention of the contact person. After all my contract is not with the person but is with the association or company whom is hiring me to do the work.
At the bottom of the contract where they sign, the person fills out their name and places their title within the association or company. Sometimes I will get two signatures like "President" and "Treasurer". Legally if the contract is made to the person and the person signs it with no title, then then the contract is with the person not the company. If The company/association name is on the contract and the title accompanies the contact person's signature, then your contract is with the company/association and not the person. Having said all that, if it were only a 3 person association I would have them all 3 sign it and have a provision in my contract stating something to the effect that all parties are laible blah blah blah so you don't get Joe saying I paid for mine, and Mary saying I paid for mine, and Peter stiffing you. This happeend to me once, we did a 3 building 12 unit town home association where we had to chase our payment from a few of the unit owners, and none of the other owners wanted to help all using the excuse "Well I paid you my share, take it up with them." |
