Collecting $; Federal Project


Looking for help/advice/info....
We're owed $ on a federal project that has no bond.
The GC owes us $; We went after the bond; Turns out the bond was fraudulent, (no fault of the GC).
How do we get the Gov't to release our $?

We did the work, in trust there was a payment/performance bond in place, as is required by the Gov't. I would think the Gov't. had a responsibility to verify the bond....after all, they were the ones requiring it!

The gov't had reasured us they were holding enough $ to cover the GC's debts to vendors/subs. However, now they're playing dumb.....i.e., no response/communication.

Depending on the agency, Gettin paid on federal work is a slow process to begin with. Bonding companies arent angles of mercy either ,if they get involved its a slow process also. Explain how the bond was fraudlant,how long since the work was completed and what agency

Time to file a lien on the property- that'll get their attention that you're serious. I'd also look into sending a letter to who ever is in charge of the agency that's running the project, and let them know that one of their underlings is running a project that's having financial difficulties, and that there's not a valid bond in place.

I thought leins were applicable to realty in the state, Generally federal property is exempt from state and local laws.

your correct cmec

There is no bond...that's the problem. If there was a bond it would be a no-brainer.....

My "angle", is that the gov't. should pay the creditors since the gov't is holding the $.....AND the Gov't was supposed to have a valid bond in place for the project/work, but was neglegent in the fact they didn't verify the authenticity of the bond.

Just trying to find another contractor who has experienced like circumstances.

What did this guy do slap a old bond up aginst a coppying machine?change a couple of letters, I will admit there are some lazy contracting officers out there that wouldnt check it.

I am not positive but I think the law is called the procurement act and it specifies everything about how the federal govt gets bids,size of job,required bonding etc.

This messege is for the person at "TNT" roofing I presume who posted in favor of more licensing in Colorado....I coudln't find an e-mail for you ..but this worked out actually better...this delimma that yoru in now is better than any response regarding "MORE" government intrution into a business and profession that has for years built fine buidlings as directed by professional ENGINEERS! I have recently {last week } had a county official - where thanks to opinions like yours now have the super power over every part of a job. Welp ... this {maybe} highschool graduate refused to accept no less than THREE stamped letters from the original engieer in an extremely small addendum for a residential roof. He OK'd the difference between type "X" drywall being used under EPDM and the similar product called gypsum "Sheathing". This man has a P.E. stamp and is qualified to build nuclear reactors if he wanted to. I had to take an entire day off due to a migrain. Are you any happier now that you are having to collect6 from any government agency? Don't take this the wrong way !!! I empathise and am not happy about your not getting paid. I jsut want to make sure you take a look at the correct perspective here and KNOW without a doubt that government intrusion rarely if ever helps and almost ALWAYS is a pain in the ass. It's about POWER not qualification.

And furtermore the I.C.C. is about Racketeering. If you research a little it starts with a licensed requirement ...THEN as in North Carolina you msut show that you are worth $150,000.oo liquide in order to go to work. Miami is only worse...the same blueprint of authority makes you put up $10,000.oo to register and you must be worth ONE MILLION to pull a permit in that city.

Sincerest of good luck getting your money. Just remember the denver International airport and talk to anyone who was a subcontractor on it. NON of them are in business anymore...they made them wait for 120 days for each and every paycheck...and IF you missed the dot on an "I" or didn't cross a "T" you had to start over.

every man and evbery company and every client/customer/homeowner must watch out for themselves. If you get people depending on others to wathc out for them...then you wind up with NOONE of particular interest with the very important job of watching out for someone elses interest...useually someone under paid...and for good reason...also under qualified...if YOU went to school to become and Engineer and then worked 4 years to get your stamp...would YOU be seaking out government work???

Hope to hear your response and that you have been paid in full...AND that I haven't waisted my time today giving you my opinion.

I know all to well about the Government being NEGLIGENT and furthermore after a building they leased and had added a parking garage to the roof { to hold all the DEA inpounded cars} ...August 5th 1974 ~ Miami, Fl. It collapsed and the families of the people killed were told they had to get the governments PERMISSION to even SUE the government...to add insult to injury it was seemilngly unethical to even a 14 year old kid to hear the Asst. U.S. attorney...who had even HIRED some of the people killed {one that I know of} volunteer his "ADVISE" clearly with a conflict of interest to a greiving family ...

More government is the answer...yeah...I'm sure ..Liek the guy from TNT was "GLAD TO HEAR about Colorado having more licensing for G.C.s.
Hmmph!

Hows that for an example...Also..there were 12 people killed...they only list 7. Somewhere they aren't even recognizing Ghosts.

Ya, try to file a lien on a federal buidling. See how far that gets you. The problem is that the poor GC saw big money and didn't have enough personal money to cover his butt. Federal jobs pay when they get to it. Could be months could be years.
