Client Won't Pay
I broke maybe the two most important rules is remodeling.
1. I don't have a contract and 2. I let the homeowners move in before paying me. Now they are refusing payment for the rest of what they owe us. Here's the deal: the tile guy I used did a terrible job. Its true and it needs to be fixed. The homeowners won't let him back in the house to fix it b/c he did a rotten job. Meanwhile, the whole time during construction, they were telling him he did a great job. Now, its unacceptable. They have gotten bids to replace the tile which are 4 times the original cost. Do we have any recourse here? |

without a contract it is your word against theirs. I would contact your lawyer for advice on how to continue.

Verbal contracts are legally binding. But, they are hard to prove.

Are they just not going to pay you, or were there conditions attached to getting final payment?
Go over the job site with them and see what they have concerns about. Try to be calm about it and agree to do what they ask. Write a contract based on the conditions and have them sign. This would put the job in a contract situation for you so you have a legal leg to stand on if you need to force collection. Remember; be nice and be calm. Don't let them know you "need" a contract. Offer a few extra things in the conditions so you get it signed.
