Can I Put A Lean? Down With Low Ballers!!!


I recently was in a situation where a freind of a friend needed a lot cleared and a house demolished.I normaly don't do demos because I do not have my gc liscence and in georgia you must be a gc to pull demo permit,although I have someone to pull the permit for me and that is what I intended to do on this property.Well this was a friend of friend so I agreed to beat any legit company's estimate for the job.The bids were from $15,500 to $26000.I contracted to do the job for $15000.The contract was signed and I brought in equipment and worked for a whole day and while I was working some guy pulls up at the property and offers to do the job for $9000 WTF.....So the "FRIENDS" tell me they are gonna go with this guy and give me $600 for my days work.I can't belive somebody will demolish a house and clean up an acre of trash(I mean 20 40yd roll offs of trash) for $9000 and spread seed and strw!!!!I took my $600 and re evaluated who I conseder friends and want to do whatever it is I can do to these people.I have a signed contract for $15000 at completion but I didn't add anything for breach of contract on their part.Is there anything I can do???

A signed contract is a signed contract. But........You did circumvent "The System" and the Proper Channels.

Call a Lawyer.

You were working as an unlicensed contractor and most likely your contract is unenforcable.

If you were in Florida what you did as well as the GC that pulled the permit and the client that hired you, all would have been breaking the law.

I think Georgia has similar laws in regards to contracting as Florida does.

I think you should just walk away, as I doubt you would prevail in court on the issue.

This is what you get when you contract without a license.

You probably can't file a lien because you broke the law in doing this job in the first place. To be honest you set yourself up for this in sooo many ways. "matching low price" "using someone elses license" I'm nott rying to be mean but you're getting what you deserve.

"Your honor I know I broke the law but this guy won't pay me for breaking it." That's like saying "Your honor he owes me money because I fronted him a half kilo of cocaine and he won't pay up now that he's sold it." I see very little difference.

Next time do what's right, get your license and insurance in order... and stop catering to low ball buyers! Focus on profitable jobs, and profitable jobs only. Just like Dan-o said, you were the low baller until someone came in cheaper, and there will always be someone cheaper, so why try to beat your compitition on price? Beat them on professionalism and customer service, believe it or not that's what many people look for over price... and let the price shopper suffer the effect of their own ill wills.


On the bright side this friend of a friend sounds like a real jerk off and it's good that you are getting to know now before you get stiffed for the whole $15k once the job is done... And for god's sakes!!! Didn't you get a downpayment for your services?

It's spelled "Lien".

I am not an expert on Georgia legal Contracts or Georgia Contractor Licensing. However, you did take the $600.00, so that means you accepted the change in the agreement.

Personally, I think you are S.O.L.

I think you should offer to do it for $8000. Ask for half down and find someone even dumber than you to do it for a lot less. Then you are a General Contractor and making the big money.
