Workers Compensation


I'm a roofing contractor in Indianapolis, In, Have workers comp on my sub crew and recently opened a shop in gulfport.Mississippi. Im just a little confused on how the work comp laws are. If I use a hispanic sub crew, pay just one guy who doesn't carry work comp, am i liable? right now i have a work comp policy in indiana and is only good for 90 days out of state. i dont want 2 separate policies. are there any nationwide companies that will insure me in both mississippi and indiana or do I have to have 2 different policies? Since i use subs I wouldn't be breaking the law if i don't get ms work comp, but want my ass covered. Any input or advise would be helpful.

Ummm....isn't this something you should have checked into before you "recently opened a shop in gulfport.Mississippi"??

Have you checked with your Indiana policy carrier? Some companies write in multiple states- they'd be your easiest source. Also check to see if MS has a state-run system you can tie into quickly.

Once statement that concerned me- "If I use a hispanic sub crew, pay just one guy who doesn't carry work comp, am i liable?" You obviously know there's something hokey about doing that, or you wouldn't be asking the question. If you're going to go down there and try to help, do it 100% above-board.

Hacking the system!

If your sub does not carry workmans comp you are liable. At least if my subs don't have WC, when I get my yearly audit I am liable and any monies I pay to them my insurance considers payroll. Therefore I require all my subs to have workmans comp AND General Liability.

If your sub falls off the roof and he doesn't have WC guess who get's to pay... You do.
