What Would Be A Fair Deal For This Arrangement?
I am being offered an opportunity from a multi-state roofing company I sell for on a commission basis. Due to lack of work the company has pulled the crews out of the area. They are offering me an opportunity to perform repairs and handle warranty calls for them.
I supply my own vehicle and pay all vehicle expenses. I stay on their liability insurance. I sell large jobs for them on a straight commission basis. I am paid per-job for warranty calls and repairs I can handle myself. I pay for all materials and supplies for repairs. If the job is too big for me to handle alone, I ask them if they want to send help or I can get help from a local roofer I know. My question: Since I am paying all expenses and managing/performing the repairs, how much of the charges should I keep and what should go to the company for allowing me to do this through them? (I'm in Florida, I can not do this unless I work through a licensed company.) Should they get a flat percentage of the charges or a base administrative fee and a smaller percentage of the charges? Any thoughts are appreciated. Thanks. |

If you do thier warranty calls, they should be paying for ALL materials. They can either pay you back after you provide reciepts or you go to the supplier and put what you need on thier account.
I pay a repairman $75 a hour with a 1 hour minimum. This includes labor for basic repairs like a pipe jack or replacing a few shingles. If it's more complicated I'll add some additional labor. This is for warranty calls only. If your doing a repair for them that is a home owner who's not a client the money is split 3 ways after the materials are paid for. 1/3 for the company, 1/3 for the salesmen who sold the repair and 1/3 for the labor. So in your case if your selling and making the repair you should be getting 2/3 after materials. Be carefull and get any comittment in writing. |

I would be pricing jobs myself. Since they have no one in the area I would have to run the lead for them. Rarely would there be a situation where they priced something and turned it over to me.
I was thinking the company would take a higher percentage on work they solicited and turned over to me and I would give them a lower percentage on work I solicited myself. What should the percentages be? For warranty calls I was thinking of having a base price plus additional for large jobs. If the repair takes 1 hour labor or less and minimal materials I charge the "base" rate, anything more than that they get the base rate plus additional dependent upon the time and materials required. |

Sounds like a very confusing and complicated arrangements. I've found the K.I.S.S. rule should be used in arrangements like this.

Brother, given ANY problem that is a litigious nightmare. In my personal opinion be a Sub or an Employee. Any hybrid mixes, and fuzzing the lines between of the two and BOHICA!

If you are already working for the company as a salesman, then you know the people your dealing with. The question should be do you really trust them, or have they been fair in the past. If you are comfortable with the way they have paid and treated you so far then I think its worthy for you to contemplate. Besides if they have pulled out of the area, will you still have work or the amount of work needed to pay the bills?
